Visa for child born outside of the UK for settled parents

Hello,

I would like to bring my 4-month old child who was born in India to the UK. Both the parents have ILR issued in the last 4 years. The child will travel to the UK with the mother. Any guidance regarding the following queries is very much appreciated.

1. Is Appendix FM (Child) the right category of visa?

2. Does any other appendix needs filling?

3. The IHS surcharge needs to be paid for 2.5 years, what happens after that? Should the visa be extended? Will the child be eligible for ILR?

4. When will the child be eligible for ILR?

Which form you need to fill in depends on whether your parent has leave to enter or remain in the UK on a 5 or 10-year route to settlement as the partner of:

a British or Irish citizen
a person with indefinite leave to remain
a person settled in the UK - for example, they have indefinite leave to remain, settled status or proof of permanent residence
a person from the EU, Switzerland, Norway, Iceland or Liechtenstein who has pre-settled status - they must have started living in the UK before 1 January 2021
a person with a Turkish Businessperson visa or Turkish Worker visa
a person with refugee status or humanitarian protection
If they do, you must fill in the Appendix FM online form.

If they do not, you must fill in both:

the online application form
the Appendix 1 paper form

3. The IHS surcharge needs to be paid for 2.5 years, what happens after that? Should the visa be extended? Will the child be eligible for ILR?
Likely you need to pay IHS but if the child is granted ILE (Indefinite leave to Enter, which will probably be the case) IHS should be refunded.
4. When will the child be eligible for ILR?
ILE is likely to be granted.

Had the child been born in the UK, the child would have been British automatically and you would have avoided the big visa costs.

I am aware but it was a conscious decision to have the baby delivered there :)

Hello again,

The online application gives the following options of appendices,

1. Non-British child of a parent (granted permission to be in the UK before 9 July 2012): Appendix 1
2. Non-British child of a parent (granted permission to be in the UK on or after 9 July 2012): Appendix 2

I first arrived in UK in 2010 on Tier 2 (ICT) and then switched to T4 student in 2012 and then switched to T2 General in 2013. Could you please advice which appendix form to use?

The IHS website at the end of Appendix (FM) - Child asks for "Visa Route" and "Visa Type" of the sponsor (myself in this case), I am currently on ILR, could you please advice what options to choose?

Update: I received my child’s visa this week. Thanks again for all your help.

I filled Appendix 1. Just don’t forget TB certificate.
