Specific Queries for Dependent Child Visa

Post by samkumsam » Sat Jul 29, 2023 7:29 pm

Hello Experts,

First of all I am sorry if I make any mistakes, this is my first post.. (my friend suggested me to use this)

I and my wife both are on respective skilled worker visas and we welcomed our baby in UK. Now baby has travelled back to India for 5 months (he has UK birth certificate and Indian passport). I am planning to bring the family back and need expert suggestions / inputs on 3 points.

1. Do I need to do anything related to TB / medical certificate for an infant? The gov.uk says if you are returning UK resident and have not been away for 2 years, you dont need this. But there is a section for children and it says -

All children must see a clinician who’ll decide if they need a chest x-ray. Children under 11 will not normally have a chest x-ray.
You must take your child to an approved clinic and complete a health questionnaire. If the clinician decides your child does not have TB they’ll give you a certificate. Include this certificate with your child’s UK visa application.

Link to gov.uk site - https://www.gov.uk/tb-test-visa

2. Generally, how much time it takes to get a child visa. I am planning to bring the child back in mid November 2023, ideally when should I apply for his visa?

3. In the application we are showing my wife is primary caretaker of my child, how much exact amount she need to maintain in her account and for how long?

Would really be great if someone can help me with the correct / accurate information

What will be granted will be in line with the validity of the mother.
Any reason you want till April 2025?

Your first post suggests you each have your own individual skilled worker visas.

When do they each expire?

Yes we both have separate skilled worker visas. Mine is ending in April 2025 and then we may go back. And my wife's visa is till Dec 2026. Now my wife is doing the dependent visa of our baby - so I was thinking why to waste money in getting the visa till Dec 2026, that's the reason I asked if I can select the duration by myself?

The child won't get a visa valid for longer than yours, ie April 2025. This is stated in the immigration rules, a child's validity will be in line with the parents visa that expires the earliest.

Apply for the child as your dependent instead then.

Good insight as always.

Thanks a lot for your responses, it is really helpful. Due to fund constraints, rather than me , my wife is applying for baby's dependent.

Do you know, the funds which they mention should be available for 31 Days from the application date or appointment date?

It is with reference to date of application not appointment.

This is outstanding, thank you so much for all your support. As you are helping me a lot, I see a ray of hope in submitting the application. Can you please help me with few more queries (I am so sorry for asking these much questions, actually my application is pending since long time due to lack of my knowledge).

1. Do I need to do anything related to TB / medical certificate for an infant? (My baby was born in UK, stayed here for 6 months and travelled to India, now I am planning to bring him back in November month means he will spent 5 months in India)

2. Generally, how much time it takes to get a child visa. I am planning to bring the child back in mid November 2023, ideally when should I apply for his visa?

3. I am confused how much fund need to be shown? (As baby was born in UK and we are in UK since 3+ years).

Would really be great if you can help me with these questions, as this will help me in moving forward with the application.

Although there are, perhaps simpler, preferable, alternative rules, they are often ignored!

Yes.

1. He may not need a TB test
you lived for at least 6 months in a country where TB screening is not required by the UK, and you’ve been away from that country for no more than 6 months
However, it may be safer to complete the process.

Children
All children must see a clinician who’ll decide if they need a chest x-ray. Children under 11 will not normally have a chest x-ray.

You must take your child to an approved clinic and complete a health questionnaire. If the clinician decides your child does not have TB they’ll give you a certificate. Include this certificate with your child’s UK visa application.
2. Apply soon, but request a deferred effective start date.

3. See also dependants’ financial requirements.

I'm in a similar situation. My visa expires in Aug 2024 and my wife's visa expires in Sep 2026, and we have a new baby. If I apply for baby's visa now, we would get validity only until Aug 2024? Is there an exemption for it? Otherwise we might be paying around £1000 for about 8 months. What's the recommended course of action in this situation? I tried to find this information online, but couldn't find it. Could you please point me in the right direction? Thanks in advance.

Note: Interestingly when I applied for my elder daughter dependant visa (as my dependant), she was granted the same validity as mine though my wife's visa expiry was 1 year earlier.
