Skilled Worker Visa - validity and application type

Hello Board Members and Admins,

Thank you for helping each other!

I was on Skilled worker Visa and got redundant recently and the employer confirmed that the Home office would be told of the change in circumstances(End of Sponsorship) in the last week of the May 2023.
Since then I have tried and now finally got a sponsored job. However, I was asked this question by the new Employer(sponsor) about my current Visa -
1. Is your Visa Valid?
Now based on my knowledge and the below facts I have told the Employer that yes Visa is still valid.
1. I have not got a Visa Curtailment letter/notice either in physical or email format yet.
2. My Right to Work is still showing the original Visa Expiry date(May 2025).

Based on the response, the Employer has went ahead and applied as per the below link:

Now my queries are
1. Am I right in saying that my Visa is Valid.
2. If the answer to the 1 is Yes then will it be Update Visa process with the new CoS?
3. if the answer to the 1 is No, then how it should have been applied?
4. In case of 3, what will happen- will the visa application be refused?

Curtailment letters take a while to be issued and if and when you get it you will have permission to stay in the UK for 60 days from the date of the curtailment letter, not from the date your previous job ended.

You need a CoS from your prospective new sponsor and once you have it you, not the sponsor. has to apply for the new visa starting from the link you provided.

There is no reason why the visa should be refused if the requirements for the skilled worker visa have been met.

Does that mean that until a curtailment letter is issued, Visa to be considered valid and hence an application can be filed as an Update(the link provided in the previous post) rather than a fresh new application. Having said that in case a curtailment letter is issued, the visa is considered invalid and fresh new application process to be followed(not sure about the link).

Your visa remains valid until curtailed by UKVI and you will have 60 days from the date of letter to make a new application or leave the uk.

You cant simply "update" your visa. You have to apply for a new visa with a new sponsor anf pay visa and IHS fee again.

Until you have your new visa, you are not allowed to work if you have left your previous sponsored job.

Visa to be considered valid till date indicated on curtailment
to leave UK (60 days from curtailment letter date) and this period can be used to get another job.
You have another job already, the application is not an update but a totally new application. Employer to sponsor you afresh.

Can you confirm if you successfully got your new visa and nothing stated above impacted.

Did you ever received curtailment letter ? and after how many days of end of employment you filed for nww visa ?
