Child born outside UK

Post by Jit » Sun Jul 23, 2023 4:16 pm

Good afternoon. I require one advise. I have a similar question. Me and my wife were blessed with a son (born in India) on 01-May-2023. My wife (in India now with son) and I both have ILR (in UK now). We don't want to apply UK citizenship but ILR (indefinite leave) or a suitable visa for our son.

Is this the path to apply for my son's ILR visa?

https://www.gov.uk/uk-family-visa/child -> Apply from outside the UK -> Apply separately ->
If they do not, you must fill in both:
the online application form (Find and apply for other visas from outside the UK: https://visas-immigration.service.gov.u ... 1686925539)
the Appendix 1 paper form (Appendix 1 for form VAF4A: family settlement as a child or adult dependent relative : https://www.gov.uk/government/publicati ... ix-1-vaf4a)

Thank you very much

1. Do NOT tag your questions onto other members topics, hijacking them. It is considered rude and unfair to other members and creates confusion.

2. Your child doesn't qualify yet for British citizenship if born abroad to parents holding ILR.

3. The links and Appendix 1 are the correct application form.
the online application form (Find and apply for other visas from outside the UK: https://visas-immigration.service.gov.u ... 1686925539)
the Appendix 1 paper form (Appendix 1 for form VAF4A: family settlement as a child or adult dependent relative : https://www.gov.uk/government/publicati ... ix-1-vaf4a)

Thank you very much, CR001. Sorry I thought its not required to create a new topic for the same issue. Apologies. Will create new topic in future if needed.

Issues in Declaration section - applying ILR for new born from India

Post by Jit » Sun Aug 20, 2023 12:35 pm

Hi All,
Me and my wife have ILR. My newborn child and wife are in India and we are applying for my child's Indefinite Leave Entry visa.

Main form:
We have filled the following forms.
https://www.gov.uk/uk-family-visa/child -> Apply from outside the UK -> Apply separately ->
If they do not, you must fill in both:
the online application form (Find and apply for other visas from outside the UK: https://visas-immigration.service.gov.u ... 1686925539)
the Appendix 1 paper form (Appendix 1 for form VAF4A: family settlement as a child or adult dependent relative : https://www.gov.uk/government/publicati ... ix-1-vaf4a)

Question:
We are stuck in the declaration section. Attached screenshot shows 4 different options. Out of them Option 2 and 3 are relevant. Please see below and guide me what is appropriate from the two following options.
Option 2: I am the applicant aged under 18 (with a text 'You will need to provide written consent from your parent or legal guardian to apply')
Option 3: I am the parent or legal guardian of the applicant who is aged under 18 and completing and submitting the form on their behalf.

If I select 3 and continue it asks for Third party declaration (attached) . Then a screen appears with Third party details. I have entered my wife's details there.
Then a screen naming 'Demonstrating your permission to be in the UK' is opened and asks for Alternative Collection Location (ACL). My wife is in India now with my child and we are applying from Kolkata. What should be ACL? Can we collect from VFS Global Kolkata office?

Thank you very much.

Topics Merged!

You cannot collect a BRP card from a location abroad. You must collect it within the UK once arrived as you will be required to present the child's passport with entry stamp.

Simply select the post office as the simpler option or click on the 'Find an Alternative Location' tab. Note we do NOT have sight of the online forms so cannot really advise if you don't post all options you get.
