Maintenance funds for a child born in the UK for visa extension

Post by Rama89 » Tue Sep 05, 2023 7:57 pm

Dear all,

I hope you are well and healthy.

I'm under skilled worker visa in the UK based on the following time periods.
First visa grant: July 2020-2023
Extension grant: July 2023 (my extension successful and granted until 2026)

My child was born in the UK on January 2022. Since we had to go to India, I applied for my child's BRP on Oct 2022. During the visa application, we submitted the bank statement showing maintenance of funds. But In July 2023, after my visa grant we applied for my child's extension without attaching the bank statement based on the below from the gov.co.uk website. I assumed my child had the same permission as me since he was born in the UK at the time of this extension as he has crossed 12months threshold mentioned below. (Jan 2022 - June 2023)

Financial requirement for a dependent partner or dependent child of a Skilled Worker
SW 33.1. If the applicant is applying for permission to stay and has been living in the UK with permission for 12 months or longer on the date of application, they will meet the financial requirement and do not need to show funds.
Now, I have received an email from the Home Office asking me to provide evidence of funds. I'm confused whether I should provide the statement and worried as the funds went below the required value just one day due to a direct debit.

Kindly can you provide some clarity on the above issue? I have 8 working days left to attach the evidence.

thank you so much in advance.

The child only had permission to stay when the visa was granted in October 2022. So no, the child has not lived in the uk for more than 12 months with permission to stay or a valid visa.

Being born in the uk doesn't give your child any status or visa "same as you". Nothing is automatic, you have to apply for the visa.

Also note that the child was only eligible for free ngs for the first 3 months, afyer which you wouls be required to pay at 150% of cost if you did not apply for a visa in time.
