British citizenship from a deceased British father

British citizenship from a deceased British father

I'm asking this on behalf of an acquaintance.

The person was born outside the UK before 2006 from a British father (born and raised in England from British parents) and a foreign mother (from South America). Both parents were married when the child was born.

The father's name is on the birth certificate of the person, the document was issued a few weeks after the birth (within the first year of the birth).

The father died about 10 years ago and the child never claimed British citizenship or was registered as such. The child has their father's birth certificate and an expired British passport of the father.

According to the British nationality website UKVI, the person "automatically" is a British citizen.

As far as I understand, the fact that the child is claiming British citizenship after the father is deceased doesn't matter, as long as the other requirements are met.

Q: Does this person still need to submit the same form UKF along with passport, both birth cert's? or being the father deceased means that they need to follow a separate process?

Automatically british, simply apply for a passport directly with proof of fathers british citizenship.

Presumably the persons parents were married to each other.

Ukf doesn't apply to married parents, it is for children born to unmarried british fathers.

I asked for clarity as they could have been married to other people as op did not stated "to each other"!!

Yes, both parents were married to each other when the child was born, and both names are on the child's birth certificate.

In this case, I also believe the child can directly apply for a British passport using the expired passport of the deceased father, as the passport expiry date is irrelevant to prove his British citizenship.

Yes child can directly apply for a British passport. Hopefully the Father was born before "1983" in England. If before 01.01.'83 then expired passport stating that he was born in England should suffice. If after, further clarity can be requested for.
