Fiancé Visa Questions

Hello,

I have questions regarding the UK fiancé visa which I would be grateful for some guidance on.

1. Can my fiancé use an IELTS Academic for UKVI test to show proof of her English language competency even if she doesn't attain the level required for UK academic study but does score above A1?

2. One of the required documents is 'one proof of British citizenship for the sponsor (such as a passport or UK citizenship certificate).' Does this mean that my fiancé needs to include my original passport with her application?

3. Does my fiancé need to include evidence of intent to return to her country of origin?

Hi, we are intending to apply for a fiance visa to subsequently marry in the UK within 6 months, with the aim to eventually apply for limited leave to remain on a spouse visa. Thank you.

One further question, please:
As for evidence of intent to marry, do you think a booking for an official wedding ceremony in her country of origin would be acceptable as evidence, or is it recommended to have a ceremony booked in the UK? Are they of equal weight as evidence?

If applying for a fiance visa, you need evidence of wedding prep enquiries etc in the uk.

A ceremony in her home country is irrelevant as that would indicate you will marry abroad, which is not the point of a uk fiance visa as you would then already be married.

You also cannot book a slot with the Registry in the uk until your fiance is in the uk as you both need to attend in person and she needs to provide proof of her visa etc

Many thanks for that. So, practically, the only evidence that one can possibly show of intent to marry in order to meet the requirements for a fiancé visa would be correspondence regarding wedding planning with, e.g. venues, registry offices, bridal wear shops, jewellers, etc?

Sponsorship Questions for Fiancé Visa

Hi, all, I have the following questions, please, regarding sponsorship of a fiancé visa:

1. The sponsor's residence is jointly owned with his parents. Does the sponsor need to provide a letter from his parents showing their agreement to have the visa applicant reside at the property?

2. The sponsor has someone renting a room at his home (the residence where he and the applicant will be living together if the visa is granted). Will this negatively affect the visa application?

3. Is it prudent to include in the application evidence of the sponsor's monthly outgoings, e.g. utilities bills?

Fiancé Visa Application - Two External Passports

Hello,

My fiancée, a Russian citizen, will be applying for a UK fiancé visa, and her passport will be retained whilst the application is being processed.

However, this passport contains her Schengen visa in it which she would choose to use to travel during the time the visa is being processed.

Apparently, Russian citizens are permitted to hold two external passports.

If she were to submit a second external passport for the fiancé visa application will the application automatically be refused? Furthermore, the second passport would not contain any of the stamps from previous travel declared on her application form.

Thank you in advance for any advice offered.

Why would it be? People change passports throughout their lives. The question, though, is if the correct passport number is entered in the form - that might cause a discrepancy.

If you're worried about that, you could upload a copy of her passport online, but I honestly think you're overthinking.

Hi, thanks for your reply.

The reason I'm unsure about whether my fiancée can use a second passport to apply for the UK fiancé visa is because I saw the following text on the Wikipedia entry for Russian passports (yes, I know that Wikipedia isn't an authoritative source):

'Russia's law allows its citizens to legally hold two valid external passports at the same time. The passport is held at the consulate during the processing of visas. A citizen who holds a second passport may not expect to obtain a visa for other trips or to apply for other visas.'

Does this mean that ONLY the second passport can't be used to apply for visas (my fiancé would ideally like to use this passport for her UK fiancé visa application), or does it mean that no visas AT ALL can be applied for with EITHER passport if a Russian citizen chooses to have two external passports?

Apologies if I'm being obtuse.

There is absolutely no source for this Wikipedia page entry, so I tend to believe it's not true. I know a number of Russian citizens that got a Schengen visa without any issues while having two passports and submitting only one; I would expect UK to be the same.

That would be a complete waste of a second passport then if you can't use it, wouldn't it?

You might want to make a photocopy of your other passport and submit that as well. This would evidence your travel history.

It shouldn't really be a problem as well because even the UK allows 2 passports at a time. Not too many people know this.

I have the following question about payslips as evidence for a UK fiancé visa please:

Firstly, I am paid non-salaried every two weeks. Because my bank statements are generated on the 28th of every month my payslip for 2 January 2024 will not appear on any bank statement until 28 January. If I apply on 7 January 2024 will it be sufficient to show payslips from the six-month period 20 June 2023 - 19 December 2023 even though I have one more recent payslip (02 January 2024)?

Yep, that should work. But add the recent payslip to the mix and explain why in a cover letter. They would be able to work out details.

Hmm, I've just rechecked my payslips and, as I've been working essentially part-time during the last six months in a non-salaried role with variable monthly pay (in order to spend time abroad with my fiancée), I'm very close to the minimum £18,600 required.

On 19 December 2023 I was over the requirement, but on 02 January 2024 I was under the requirement. Presumably it would be extremely unwise to apply on, say, 05 January 2024 with payslips for the six-month period 20 June - 19 December. Correct?

Hi, folks,

I'm hoping these are the last two questions before submission.

1. Three of my (sponsor's) payslips show a net figure higher than the gross figure (the net corresponds to the sum paid into my bank account). Will the entry clearance officer be prepared to use the net figures in the financial requirement calculations for these three payslips or not?

2. My bank statement for January is not generated by my bank until 28 January and so I cannot show my final payslip being deposited into my account by the visa submission date. Is this likely to be a problem, and, if so, is there some form of evidence I can request from the bank in mitigation?
