Tier 2 Dependant ILR visa -salary query

Post by mat30mat » Sun Sep 17, 2023 11:37 am

Hi everyone, my husband who is on Tier 2 dependant visa will soon submit his ILR application in October.

I'll be showing my salary slips/bank statements as his sponsor.

My understanding is that I'll have to provide previous six months bank statements, however, I wasn't paid for the month of March & April 2023 (last two months of maternity leave)as I was on maternity. I joined in May and have been getting salary since June, that leaves me with only 4 months salary slips, however I do have sufficient maintenance funds.

Will having only 4 months salary slip affect my husbands ILR application, would they consider maternity as an exemption for the missing salary slips of March & April 2023.

Many thanks in advance

There is no financial or maintenence requirement for pbs dependents applying for ilr. Never has been.

Documents required for ILR dependent Visa

Post by mat30mat » Mon Sep 18, 2023 12:58 pm

This group has a wealth of knowledge, apologies if this has been asked before. I was on Tier 2 Health care visa and have recently got my ILR.

Now I want to apply ILR/settlement for my husband as well who is on dependant Visa.

I'm confused about the English test category he needs to take, is it B1 SELT from trinity college?

Also, if someone could please provide a document checklist for Dependant Visa ILR (Health care visa). Thanks in advance

SELT at B1 is offered by many test providers including Trinity College.
See: indefinite-leave-to-remain/faqs-english ... l#p1906260

Very minimal documents. passport, BRP, LIUK, English language and cohabitation evidence for the last two years

Just to check, is your husband going to get ILR as PBS dependant, not as a spouse of a settled person?

Tbh honest I'm not sure myself, I have a settled status or ILR, I was on Healthcare Visa from NHS.

Not sure if it's PBS dependant or as spouse of a settled person. Maybe you or others might help.

Intact what's a PBS dependant :|

Going by your previous post, your spouse was in the UK as your dependant on Skilled Worker and I assume that's their route to ILR.

It should be SET (O) then - SET (M) would be if someone spend 5 years on a visa given to a dependent of someone settled/British, which is not the case.

PBS dependant - Points Based System dependant (dependant of someone who is in the UK on a Points System visa).

@meself2 thanks again for your swift response, that makes a lot of sense, whole process is tedious and not to mention costly, but I can rely on this forum :D

Question about Public funds

Post by mat30mat » Tue Sep 26, 2023 11:19 pm

Hello all, I'm filling ILR application on behalf of my husband who is on PBS dependant visa, there is a question about "Public funds "Do you or anyone else who is part of this application receive any public funds. Include details fof your partner or child.......

Now, this a tricky one, I recently got ILR and filled the online form for child benefits but haven't sent the hard copies or neither have received any benefits so far as the process is part complete

In this circumstance what should my husband select YES or NO, as me being his partner has filled for child benefit but not received any funds...if he submits NO...can the Home office refuse visa for giving wrong information even though...we haven't received any benefits

It's a NO and will not be done for it. You the spouse claiming it.

@AmazonianX thanks :)

Another question while filling the form for my husband ( PBS dependant) it asks for the partners visa status

Which visa is Mrs xxxxx applying for or been granted?
Choose the route that Mrs xxxxx has applied for or been granted, even if their application is still being processed
.

I selected Tier 2 General, however im a bit confused as I already have ILR should the options not show that? Instead it's asking my pre ILR status..I just want to be sure that I have not selected anything incorrect in the first instance...the form is SET(0)

It is correct. His ILR is based on your previous route as a worker !
