ILTR - "Evidence of parent responsibility" for 16-year old

Post by randomwelshman » Sun Nov 19, 2023 3:20 pm

My wife is applying for ILTR. She and I moved to the UK in 2013. I am a British Citizen, UK-born, UK parents, brought up in the UK, but lived in my wife's country for nearly 20 years. My wife was granted a visa in early 2013. She was then granted discretionary leave to remain in early 2016 on the 10-year route, as we had problems initially in meeting the financial requirement. Since then we have had no problems meeting the financial requirement, and her 2018 and 2021 extensions went through without any problems. We have two children 16 and 14, who were born overseas but applied for and received British passports in 2015.

I am in the process of going through the (surprisingly short) checklist for uploading supporting documents for the ILTR. Any help from the forum with the following would be greatly appreciated.

1) The checklist asks for her passport and biometric card. For the passport, should I scan and upload only the biometric pages and stamped pages or the whole thing?

2) The checklist also asks for "All previous passports, travel documents or national identity cards that you have used to travel to, or remain in, the UK for Mr XXX" where XXX is myself - the applicant's husband. As mentioned above, I am a British citizen, and that is clearly stated on the final application form, so I'm a bit surprised that this is required. I intend to upload the biometric detail pages of my previous and current passports. Will that be enough?

3) The checklist also asks for "Evidence of parent responsibility for Mr XXX", the elder of our two sons. He is 16 and still in full-time education. I remember the application mentioning the kind of documents needed somewhere, but I cannot find any details of what is acceptable as evidence.

Given that he is not yet adult there is little documentation we have to prove that his address is the same as ours (which I guess is what they want to see). He has a bank statement, a national insurance number letter, and a letter from his secondary school stating that he is in full-time attendance. Can anybody give some advice on where to find details of what is needed, or simply what is required?

Many thanks in advance,
Welshie

Also for some reason they don't appear to want anything for the 14-year old, which feels odd to me.

Did you by by chance add the child as an applicant in the form in error?

Thank you for taking time to reply, and for the suggestion. I wondered the same, but "Is anyone applying at the same time as you?" is set to "No".

Then under "Non applying children" I have both children listed, and "Country of nationality" is set to "British Citizen" for each child. "Is AAA/BBB completing a Settlement application to the UK at the same time as you?" is set to "No" for both.

So it's a bit of a mystery at the moment.

The checklist is not smart. It may ask you for documents that are not necessary at all, in this case asking the documents regarding safeguarding children who are not applying with you. You do not need to provide anything regarding the British children or provide your travel documents at all.
