Hi,

My wife is the visa holder. She completes 5 years on 28th November 2023. I have few questions that I'm confused about. I searched through the forum but could not find information matching exact scenario.

1. Our daughter was born in the UK in 2021. My understanding is that she does not need an ILR as she has Entitlement to registration as a British citizen via Section 1(3) - as soon as my wife's ILR is granted. Is this correct?

2. My 5 years completes on 27th December (1 month after my wife's). Therefore I cannot apply along with my wife right now. She is concerned that the letter she got from her employer to support the ILR application may be considered too old if we apply together in December. Is there an official guidance on how old this letter can be?

3. I initially entered the UK in 2015 on a Tier-2 ICT visa and switched to PBS dependent in 2018. I understand that dependents need to submit ECCTIS certificate on English Language Proficiency. Is this still mandatory if I had originally arrived in the UK on a work permit myself. I'm trying to avoid this as getting this could potentially need a visit to India.

Why do you, a dependent, need a letter? You don't have to apply together. Just wait until you qualify.

Did you prove your knowledge of English before? Did you do an English test on a level B1 or higher?
If not, you can do a B1 test in the UK.

Hi,

I'm on the ECCTIS website to apply for my English language certificate. I'm not sure which option to select here. I'm the depependent and my partner has Tier 2 Skilled Worker visa. We're both applying for ILR now. Is it "Skilled Worker" or "Family, ILR and Citizenship"

You need to apply under Visas and Nationality service (English proficiency) from Ecctis and choose ILR.

Thanks! Few more questions:

1. My partner has already applied for her ILR. Do I need to wait for her decision before I apply mine?
2. If I dont have to wait for her decision, do I need any info from her application? like a reference number or do I need to reuse her employer letter confirming she's required at job for the foreseeable future. Or a cover letter of some sort?
3. When applying separately do I need to use SET(O) or SET(M)? Saw conflicting posts on this. Clarification is appreciated.
4. Coincidentally, my passport has expired recently and still havent received the new one. Can I apply for ECCTIS English Proficiency certificate with the expired passport?

1. Yes, you need to wait as she has already applied. You can apply only if she gets ILR. What is your visa expiry?
2. You do not need any of those. Your application will be a separate application. Dependants have separate requirements to satisfy for ILR under the rules
3. SET(O). You are NOT a visa holder under the family route, so you must NOT use SET(M) :!:
4. I am not sure what they ask for that application. You can instead sit a SELT test rather than going through the whole ECCTIS thing

Unable to find time for a test with multiple things going on. Both cost about the same. Spoke to them earlier & they suggested me to apply with what I have now & if it isn't sufficient I can upload my new passport after I get one. I need to wait for the passport anyway for the ILR application - it doesn't seem to take an expiry date that's in the past.

New question, sorry.

in my SET(O) application, its asking for various reference numbers of my partner. I'm assuming not all the reference numbers are mandatory. So,
Passport - Given
NI number - Given
Home Office reference number - Not sure what this is. She has a UAN number for her ILR application. I can give this or just ignore this field?
BRP - Can give current BRP number? or ignore the field?

UKVI does not operate blind. They know who you depend on which is recorded on their systems. There is no need to provide any home office reference number

Hi All,

I'm at this question on my application:
What will you use to prove your degree taught in English?
The available options are 1) Degree certificate 2) Official transcript or letter (from college)

I chose option 1 but no where does it ask for the ECCTIS letter. Is that right? Do we just add Degree & ECCTIS letter to the documents?

I finished the application now & while uploading the documents, its asking to upload consent from my partner. Assuming this is the same as what I downloaded earlier. Does she need to sign part 2 or part 3? Both dont feel entirely right. Note that she already got her ILR & I'm applying separately.

Part 2: She is not a joint name on any of the evidence I'm submitting.
Part 3: She is not 3rd party (another person)

Do I need to submit proof of cohabitation if I'm applying separately?

I've seen that it is asked when applying together. I wasn't asked for it in my application, but lot of confusion online on whether its required for separate applications.

The guidance notes etc are not detailed/exhaustive enough yet can be refused for not providing such unmentioned evidence hence where forums like this comes in to create awareness.
Should it be a joint name doc only? Like a council tax one?
Could it be separate docs each with our own name but same address (like our separate bank statements)? If joint named, provide 6 for you both, if individually addressed then 6 for each, 3-4months apart covering last 2 years. A mixture of joint and individually named are also accepted.

From at least 3 sources. You can not just use all bank statements.

The document list is not always accurate. It is not conclusive.
Cohabitation evidence is not mentioned in the rules. The rules require you to have lived in the UK in a subsisting genuine relationship, hence the home office procedures historically required cohabitation evidence.

Hmm.. does each source need to span across 2 year period, spread 3/4 months apart?
