Spouse Visa Extension

Hi, I put my wife’s spouse visa extension application in 3 weeks before the existing on expired. However, the first appointment to scan documents was the day after her existing visa expired. We received an email from immigration saying they could not process the application in the normal time. Is this because of the paperwork was only been scanned the day after her visa expired? If anyone can help please. Thanks

No it isnt.

It is a standard email if there will be a delay.

Hello, we put my wifes application in for a spouse visa extension on the 17 July. All we have recieved since then is the following email. Does this mean it will be turned down? We are very worried.

We apologise for the inconvenience, but due to further checks needed on your case we are not able to meet our usual service standards.



Although we would normally decide your application within eight weeks from the date it was submitted, unfortunately this may not be possible in your case.



If your application was submitted prior to your current grant of leave expiring, your current status within the United Kingdom has been extended by section 3C of the Immigration Act 1971. You do not need to do anything else at this stage and do not need to be concerned about your immigration status.



If you have applied to switch your status in respect of your employment or studies then please refer to the guidance on Gov.UK as you should be permitted to commence work / study prior to your application being decided, should you meet the conditions set out in the guidance.



We apologise for the delay in dealing with your application and for the inconvenience this is causing. Please be assured we will do all we can to make a decision on your case as quickly as possible.

It is a standard email that many applicants across various visa categories get when UKVI need more time.

You were already advised of this earlier this month when you asked.

What is known is that it can take up to 6months and even more for some others.
You ab initio got the email that processing will be delayed

It is unlikely that the delay is due to her nationality, given this is an extension application. If your spouse has maintained close links with Russia and is part of a wider family that is considered a threat or is being under sanctions then you would have been very aware on that by now.
I think it is just the usual waiting game for the extension to be granted.

Hi my wife has never been back to Russia since she came to the UK. BUT how will this increase in the required minimum wage affect our current application and applying for ILR in the future as we simply do not earn this amount or any where near? Will this apply to these applications as seems unfair as the wage needed was £18600 when we started. I have recently had a stroke and I should get Attendance allowance. I have read that this benefit exempts me from the minimum wage is that correct? Lastly I do depend quite a lot on my wife now as there are a lot of thing I can’t do without help.

All these new salary requirements announced today will be in place at some point in Spring 2024, according to the Home Secretary.

Any current application can not be impacted for something that it is not yet officially implemented. :!:

When the rules changed in July 2012, it applied only to new applications for family/spouse visas from that date. Even now, there is still a route for those who were on the pre July 2012 spouse visas, meaning the pre July 2012 rules still apply to them.

The potential change to the rules is related to income, it is unlikely to affect those who receive a qualifying benefit and qualify under the Adequate Maintenance provision.

Hello, we now have a problem with my wifes work. Her visa expired on the 3rd August, we made the application on the 17th July so she is covered by section 3c. However her works wont accept this even with proof of reciepts, they say that they want a share code. I have done this before but I cannot find how to do this as of course the visa is expired and not accepted. Does anyone know how to do this?

The employer should use ECS.

There is no certainly when you are waiting for a visa application outcome, with the Home Office no news is neither good nor bad news.
Could it be held up because of her Russian citizenship, perhaps but unlikely. I am aware of Russians entering under spouse visas since the Ukrainian war, so that is in itself appears not to be a barrier.

Is the Home Office understaffed and are there probably backlogs, do brown bears visit the woods… ? I don’t want to diminish your situation and the stress is very real and understandable.

I would approach your MP as suggested above, but the force that MP’s querying the Home Office is really not the way it was some years ago. Very often they get a very standard letter that says very little.
