ILR for spouce 5 year route

Post by arshah » Mon Oct 09, 2023 1:06 am

HI ,

I need to apply ILR for my spouse on 5 year route

1) I am confused with so many ilr forms like set(o),set(m),set flrm, please kindly update me which is my
correct route name?

2) can i apply for ILR 28 days prior to 5 years since arrival to UK or we have to wait 28 days prior to
current visa expiry date ,As we got 5years 3 months visa in total.
3) Is there any particular thread for 5 year spouse route?

It would be great if I get my questions answered

Thanks in Advance.

Assuming it is a spouse settlement visa, it is form SET M if all requirements are met.

You can apply within 28 days before the 5th anniversary of the UK entry date. The latest you can apply is the visa expiry date.

There is no general thread for a spouse visa, simply ask your questions in the topic you started.

Yes it has changed. Its the URN that will be used in the application.

COUNCIL TAX LETTER COMPLICATIONS.

Post by arshah » Thu Oct 12, 2023 1:58 am

Hi,
ILR On 5 year route (spouse settlement) SET(M).

ME And my spouse both of our names Appear on council tax statements.
as I was on benefits Our statements showing council tax benefit deductions.

1) If I submit these statements will they grant the ILR As she is not entitle for public funds.

2) I ask council to remove my spouse name from the statements as my spouse is not entitle for benefits.
they refused to do so explaining everyone at address must be on the statement.

3) if the statement is only in my name( SPONSOR) with benefit deductions is that ok?
if the statement is only in my name ( SPONSOR) without any benefits deduction ( As i am thinking to close my small amount of benefits Account )
4 ) if the statement is only in my name (sponsor) , will home office raise a question why your spouse ( ILR Applicant) name is not added to council tax letter, when you both living together

please kindly help me.

UKVI will check with DWP to see if someone claimed benefits or not. What is on that letter has no relevance here

We do not know when the new threshold will be effective from or if they affect current spouse visa holders. We only know what has been reported and announced by the government. No rules have changed yet.

You were already advised when you asked this question in October, that it is the date of arrival that starts her qualifying period for ILR.

No, she is eligible within 28 days before 19th May 2024, the 5th anniversary of the date she ENTERED the UK.
