PBS dependant visa extension when spouse has got British Citizenship

Post by demirider » Tue Jan 02, 2024 7:51 pm

Hello gurus

My current PBS dependant visa expires in April'24. First time issued in Dec'19 as Tier 2 Dependant visa, renewed in Apr'21 as PBS dependant but by then wife had an ILR. Around this time she is a British citizen. I am filling up the Skilled Worker Dependant Partner Visa form (is this correct to keep my counter intact?) but am not clear on how I should respond to the following questions in the form-

1. Does Partner already have their Skilled worker visa? (not sure since she has a British Passport)
2. Do you have Partner's UAN? (which UAN would this be?)
3. Do you have an application reference number for Partner? (which reference number would this be?)

Would really appreciate your guidance.

Thanks

Your visa is based on her previous status as a skilled worker. Her current status is irrelevant.

1. Yes
2. Ignore
3. Ignore

Hi, I had one more question as I'm filling up the form for IHS. When the main applicant is on ILR/Citizenship, I'm aware that the work start and work end dates are merely to calculate correct IHS payment for the dependant.

My current BRP is valid upto April '24, does it make sense to put work start date from the next day my current dependant visa expires in April since I have already paid IHS upto this period?

No. You put the start date as the date you will apply and the end date exacly 3 years in the future to pay 3 years IHS.

The immigration health surcharge online system is not smart enough to calculate this automatically. ILR has no expiry date. You should enter a date that is 3 years in the future to get a correct IHS calculation. Otherwise, the system will charge you less and the caseworker has to request you to pay the remaining fees, delaying the application.
