5 year route calculations

Dear all,

I am applying for my wife's visa extension . This will be her 2nd extension on 5-years route. She is married to me and I am/was British citizen when she got her 1st visa.

I am confused as from what date I should start calculating her time in UK for 5 years route as she got different dates

1st visa on Passport 16/06/2021 - End date 14/09/2021 - Couldn't fly as our country was in grey-list for covid
2nd visa on Passport 28/09/2021 - 27/12/2021 -
Landing date 11/01/2021 - Couldn't get earlier dates as most of the flights were booked
BRP date - Date of Issue 10/06/2021 to 16/03/2024

If I start from BRP issue date, it will be 33 months, If I start from Landing date, it will be 28 months. If I start from 2nd visa date, it will be 29 months

Assuming they give me another extension for 30 months, it will be either less or more than 5 years which means I might need to apply for 3rd time

Can someone please help ?

Her qualifying period for ilr starts from the date she ENTERED the uk. Her visa issue date is irrelevant.

So if it start from landing date, it means she has 28 months visa till 16.03.2024 and if they give her another 30 months, she will have only 58 month, short by 2 months

Does it matter the she couldn't travel from 16.06.2021 to 14.09.2021 because of Covid-19 grey list restrictions ?

I was told by a lawyer that they might give her more than 30 months

Also she doesn't need to apply for ILR, she can directly apply for citizenship

She will possibly get an extra 28 days plus 30 months. That is all.
Also she doesn't need to apply for ILR, she can directly apply for citizenship
No, she needs ILR before she can apply for citizenship. Ilr is mandatory for citizenship.

Does it mean that we have to apply for 3rd time as even with extra 28 days she may not meet full 5 years

Date of Entry 11/11/2021
Date of future visa expiry + 28 days = 14 Oct 2026

Total duration - 4 year 11 months 4 days

So just for another 26 days I need to apply again ?

She can apply for ilr within 28 days before the 5th anniversary of her date of entry.

Normally, when you submit your extension visa they give you 2 months to book the biometrics appointment and even after that can take up to 8 weeks to come to a decision. If you submit your application close to the end of your current stay, then book the biometrics appointment late enough (i.e. another month or two later), you will probably get a new visa date late enough to not require extending again. That is all you can do really, apply within the time frame but take the slowest renewal route possible.

ILR eligibility is possible within 28 days of completing the 5 years, so you do not need the full 5 years to be granted ILR.
