Set M ILR help with accomodation query

Hi All

Thank you for your constant help...i have followed this forum for years and it has been a god send.

I have a few queries and would be grateful for your help...i am applying for the ILR and filling out the SET m application.

Re accomodation

- In the SET(M) online application under the question "Do you own or rent your home?" i do not own the home, my husband owns it and we live together.

-Then there is a follow-up question on the form which asks "Do you currently live with parents, friends or family rent-free?". I'm not sure whether or not to answer this as Yes or No. We are married but isnt this just a repeated question to the above

Re finances

- i meet the financial requirements, and so does my husband? i feel its overkill for him to put all his financial docs in if i meet it already. Is me enough? or do we need both?

- i have savings - is it worth providing if i meet the requirements just by my salary income ie 31k per year? or is my payslips for 6 months enough? i have been with my employer for 4 years now.

Re husbands status in uk

- my husband is Irish. at the beginning of the application it states whether my partner is a british citizen, settled, or EEA national with permanent residency? which one should i tick? because technically both the last 2 apply.

just a quick note

Go with either then, preferably the one that is least cumbersome to prove

HELP WITH PARTNER SETTLED STATUS

Hi All

I am filling in the Set M application for my ILR application as a partner of my EU (Irish) spouse.

In the section where it says 'What is your partner's basis for living in the UK?', there are 2 options.

a. British (he is not)
b. Settled
c. EEA National with permanent residency.

I have put B (settled) as Irish citizens are considered settled in the UK with indefinite leave. This is correct option right?

Also it says 'What type of visa or leave did your partner use as the basis of their settlement?' and 'date obtained'

I have put put in Irish passport and then his DOB for the date obtained. Surely thats right because we do not know exactly what date his passport as a baby was issued!

Any help would be much appreciated!!

Im on a spouse visa

on my vignette upon entry to the UK 5 years ago it has on it 'D- partner (standard)'

on my BRP it states 'spouse/partner Leave to remain'

Was just checking visa to ensure you did not have a EU Family Permit or pre-settled status under EU rules, which would have been possible and cost nothing,.
I have put put in Irish passport and then his DOB for the date obtained. Surely thats right
This is fine, he is Irish from birth. A passport is just a travel document.

UKVI do know the rules etc.

yeah i know we could have done that but our circumstances were difficult at the time and we went for the quickest application where you pay a premium to get a quicker service! we were in two different continents at the time.

final question - where it says ' do you own or rent your property' i put neither as my husband owns the property. in the box it then says who provides you with accomodation? i put husband. I guess that's ok right? we will provide all docs showing this like mortgage statement etc.

Hi All

I submitted the set m application on the 21st January. Spouse visa 5 year route.

my biometrics is on Saturday.

I would be most grateful if you could help with a couple of queries i need answering please ...

1.) bank statements and payslips..i have provided this from august 1st until 26th January showing my latest payslip (25th Jan) so 6 payslips in total. Do i need to include july? IE 6 months from 21st Jan so 21st July? That would mean 7 pay slips though. or is january not required?

2.) can i include another bank statement (like a monzo) - my main bank is natwest - as a proof of address?

3.) me and my husband have 4 co joint letters from 2 sources IE water and council tax and thats all we have together....do i need to provide another 6 seperate letters as well as does he? collating the previous 2.5 years? how many different sources?

4.) my bank have provided me with stamped online transaction statements in the branch which looks slightly different than an online digital statement. trust thats ok? it still shows my bank, branch, name address,transactions, salary payments etc

You can include July, ideally evidence are to be dated till application submission date, you submitted 21st January.

just for my sake of sanity, how is it not guranteed? i understand if they require more docs from you etc or your application has gaps in it that they require a bit more information. However if everything is there surely they cant take 1000 pounds of you and respond in say 2 weeks or an indefinite timeframe when they said it would be one working day!?

Even without needing additional documents, decision may come later than what you paid for. In such circumstances you get refunded or request for a refund.
In situation where a document or the other is missing from your uploaded documents and you need to provide it, then no hope of a refund.
