Enquiry on ILR application (Tier 2 route)

Hi Moderator,
I would like to ask several questions regarding ILR application
So I have stayed in the UK for almost 9 years (Tier 4 student visa + Tier2 general) and I want to apply for ILR using the Tier 2 one. Below are the questions:

Nationality : No problem with this as I successfully applied for UK visa many times ( I always use Hong Kong here)

Life in the UK test: Pass but nationality there a bit different from my current one (staff there told me to
change to China, I accepted that but in visa applications china and Hong Kong are always two different options, let alone HK BNO)

Absence information: my current tier 2 started on 23/01/2019 and expires on 01/04/2024. So I just need to input the absence info during this period right? And regarding when did I enter the UK, I should just put the tier 2 one even though I were living in the UK before this tier 2 period, right?

Evidence to support the absence leave: My leave is holiday so just choose "Letter(s) from employer(s) detailing reasons for work-related absences including periods of paid annual leave from the UK and Crown Dependencies"

Sponsors: Currently I have one full-time and one part-time job. They have different employers but the jobs have the same type. My current Tier 2 visa is associated with the full-time job. Therefore, I just need to input the full-time job sponsor info right (the salary in this job is already above the requirement)? My part-time job is provided by a Top 3 UK university (they said 2 jobs for Tier 2 was ok so I trust them :cry: )

Previous Immigration history: I can provide the Case number for my current tier 2 but tier 4 ones probably loss, so I guess I do not need those right?

Tier 2 does not exist anymore. You will be applying for ILR under the skilled worker rules in place now. :!:

This is not an issue.

Your part-time job is not important as long as you are abiding by the rules regarding the type of work you're doing as a second job

Just realise maybe I made a big mistake about my old BRP card

I forgot to return it to home office (due to covid period :cry: )and I do not know where it is. Will this affect my ILR application?

Not any negative impact I am aware of. You can go on with your application.
Thanks, just check my previous home officer letters and only the Tier 2 one mentioned returning old BRP (Tier 4 extension & doctorate extension scheme not mentioning it at all, with my initial Tier4 in my passport page w/o BRP issued :lol: )

I also heard that BRP will be replaced with evisa in Jan 2025

That is a total non-issue. All BRPs will be phased out from 2025 onwards

ok, I am about to apply for ILR via work permit route (previous Tier2) using the SET (o) form
I know the employment letter is asked many times in this forum but just want to double check :lol: :

I will use the following template for the sponsor letter:
"Please accept this letter as confirmation that xxxx is currently employed by xxxx as xxxx in the Department xxxx. xxxx mainly works in his expert field of xxxx. 'Couple of sentences about my work'
xxxx’s contract will continue for the foreseeable future, in line with the below.
Contract: Full-time,
Start date with xxx: xx January 2019
Annual salary (gross): £xxxx
SOC Code: xxxx
*Further funding has been to confirmed until 14th August 2024 and xxxx’s will be extended until this date.
I can confirm that the current salary of £xx exceeds the going rate for SOC code xxxx, which
is xxxx

Thanks."

1. I will add absence leave details in this letter like "Date out/Date in/Total date/Destination/"
this is not necessary according to the rule, right?
2. I will put my annual salary of my main job (32 hours) vs annual going rate for the SOC code (37.5)
is this ok?

If letter can simply state your services required for the foreseeable future. If not, this may suffice.

I see this in my SET (O) form "Note 8 please read the guideline on the " code of practice for sponsored workers" which is contained in our website
I find note 8 on the official website where the SOC code salary (2126) is 29100. But I check the latest salary for that is 34100. Which one is correct?

For me my salary is higher than both so my worrying is which one should I use in the letter

That is the minimum salary threshold required. You use your current salary

Sorry Zimba, I think I must miss sth or did not state my question clearly

Let say my current salary is Value A. From note 8, the SOC salary is Value B. From the latest info in government website (not from note 8), the SOC salary is Value C. My question is should I use value B or C to compare my salary (value A)?

Another question is I am using my annual salary which is the one shown in my payslip. Do i need to recalculate it based upon 37.5 hour ? because I am only working 32 hours and this salary is already higher than required

ok, I think I know why.
"Note 8 please read the guideline on the " code of practice for sponsored workers" is for old Tier 2 I guess because I see "tier 2" mentioned in code of practice for sponsored workers (probably archived document, I blame google for that )

This sentence should not appear in the ILR form. It is not "code of practice for sponsored workers" now

I will use the latest info to get the salary requirement from this link

ok just submitted it. Holy moly the appointment slots are mostly occupied :shock: and the cost is increased to (139 ~ 210 pound). Am I looking at the correct thing? :D

So the standard service is not providing scanning anymore? well I have scanned them anyway

Yes you indeed are. Cost of living increased, and so does cost of services following suit

In the upload website, there are two document types :

1. A document from the sponsor who issued the certificate of sponsorship that led to your last permission to stay as a Tier 2 migrant confirming that you are: still required for the employment...

2. Letter(s) from employer(s) detailing reasons for work-related absences including periods of paid annual leave from the UK and Crown Dependencies

I only have 1 employment letter covering both 1 & 2 . Do I need to upload it twice for different categories ?

Also the "Current Biometric Residence Permit" and "Evidence of xxx immigration status" look the same to me
(upload BRP twice?)

1 letter can cover both. Your choice if you so wish to upload twice; same for BRP and yes, HO knows BRP serves both purposes.

Time to contribute to the forum:

My online application submit date : 14th Jan 2024 (500 priority service)
My biometric appointment date: 20th Jan 2024 (~130 standard, bedford point London )
Approved date: 23th Jan (exactly 5 years)

Job type: 2 jobs (even prepared payslip of the 2nd if required)

Here are some points related to the biometric appointment:

1. I did not buy the extra service but the staff there still offered scanning for me for free
2. The staff actually will check your documents. I even heard she mentioned ".... for the foreseeable future... checked blah blah blah" (yes she was quickly reading my doc)
3. The staff will check your passport and only scan stamped pages
