Hi I am student in United Kingdom and I am getting sponsorship of care assistant role in United Kingdom my questions are
1 can I switch my visa after my course completion date on my CAS letter which was o7 feb2023 or do I have to pass degree before switching to care worker visa as I am still waiting for results of my dessertation
2 can my family stay with me as dependent in United Kingdom if I get COS before 11 march 2023 and apply visa after the new rules will apply .
Your answer will be much appreciated .

You can switch to skilled worker visa as long as you have completed your course.
As long as the COS for the care assistant role is issued before 10 March 2024 you can apply for your dependents too.

It means if could not pass one of modules ,I can switch to care assistant visa as I have completed my course date ?

Basically the guidance states course completion, it does not say anything about successfully completing the course. So as long as you stayed with it till the end and the Uni has not withdrawn sponsorship then you can switch.

Thanks for your reply .as my employer has applied for my COS .i will have COS before 11th march untill which date I can apply visa .my main query is that will my dependents will get visa even if will make application after 11th march on COS issued before 11th march

If your employer has only recently applied for a COS then they are highly unlikely to receive it anytime soon. Unless they have applied under the priority application process.

If the COS is issued to you before 11th March 2024 then based on previous cut off rules you should be able to apply after 11th March and still have dependents.
If the COS is issued to you after 10th March you will not be able to have dependents.

Did you read below previous response?
If the COS is issued to you before 11th March 2024 then based on previous cut off rules you should be able to apply after 11th March and still have dependents.
If the COS is issued to you after 10th March you will not be able to have dependents.

I have seen the reply .but today when I see the caseworker guidance for dependents in care worker visa ,it clearly say that you should have made application before 11th march ,please can you share link with where I can see these cutt of rules .

The published guidance which came out today states that the application has to have been made before 11th March for care workers to have dependents.
This a departure from previous policy where the date of assignment of the COS sets the rules in play. This is a hardline approach and is probably subject to challenge. Issuing guidance on the day of change is legally unacceptable.

Is it still worth applying to keep my dependents with me .because I do not want to stay here without my three years old daughter ,as a mother I can not be without my daughter .

As the Home Office only issued their guidance on the date of change. That is basically too late and in my opinion is subject to challenge.
HOWEVER at this moment in time it is a pointless exercise applying for dependents on a carer SOC, they will be refused and you will lose the application fee.

My visa is going to expire if I do not apply I will be illegal .and other thing if I do not apply for dependents I can not be without my daughter .

The policy is designed to prevent new care workers having their dependents in the Uk. You simply don’t have a choice about whether your dependents are allowed or not - it is a no.
Unfortunately you are one of the first group of students switching to care worker roles that the policy impacts.
