Enquiry about DCoS

Hi there.

Just I have enquiry about the duration of contract between our company and our potential employee.

Our company license for sponsorship expires on 2037
So we made the start date of job on 15-03-2024 and the end date of the job 14-03-2029.

So is there any problem? because we got rejection in our previous application for the same employee due to the salary and they asked us to increase the salary, but in the previous application we made the duration of the contract 3 years.

So now with the new application we increased the salary and duration of the contract from 3 years to 5 years.

So I want be sure that won’t create issues with HO.

Assuming typo 2037 is 2027?

There is not an issue with COS dates going beyond your license expiry date.
If there is not an absolute need to for the COS to be five years I would stick to the original three years. The costs for 5 years for you as Sponsor and your employee are very significant.

Tnx for reply, however for the date of the expiry of the license it’s 2037, the HO extend all licenses expires on 6 April or after for 10 years, it’s announced on 14-02-2024.

This is the original announcement from HO:

FOR THE ATTENTION OF ALL SPONSORS WITH A LICENCE EXPIRY DATE ON OR AFTER 6 APRIL 2024: From 6 April 2024 we will remove the requirement to renew your sponsor licence. If your licence is due to expire on or after this date you will no longer need to apply to renew your licence or pay a renewal fee. To prepare for this, we have extended licence expiry dates on all licences due to expire on or after 6 April 2024 by 10 years. You do not need to take any action.

I understood your point and our company can afford the expense so we wished to apply for one time 5 years that’s why.

If the employee is able to pay all the costs for a five year visa by all means go for it.

I believed that up until 6th April 2024 new licenses would still be for 4 years. Every day is a learning day.
The policy states that renewals after 6th April automatically get a free 10 year extension.
All new licenses are supposed to have no expiration date.
Hence my confusion
