Payment for ILR

Hello house please I need your guidance on when to make payment for my ILR

The date on my entry clearance is 29/03/2019 and I entered the UK 14/04/2019.

When I picked my Biometrics it shows 22/03/2019 to 29/12/2021.

I am about to apply for my ILR, following the 28days rule, can I make payment for the application on the 2nd week of February 2024 and book an appointment 29th of February. Will this be acceptable or lead to a breach and make my application rejected?

Also, in the application, there is a place where I was asked "how many years I have stayed in the UK". Will it be wrong if I put in 4years and 10 months in February since I entered April 2019 would this have a negative impact on my application given I haven't stayed for 5years.

Useful to state what visa you hold. Different visa routes have different start points for qualifying for ilr.

I have spouse visa and the date on my entry clearance is 29/03/2019 to 28/4/2019 and I entered the UK 14/04/2019.

When I picked my Biometrics it shows 22/03/2019 to 29/12/2021.

The 22/03/2019 can be found in the letter sent to me which state my visa commence on the 29/3/2019 to 29/12/2021. But I don't know why my biometric start date is on the 22/3/2019 to 29/12/2019, and if I can use the 22/3/2019 When making my ILR application.

For ILR under the family route, your qualifying period starts from the date of entry to the UK. The date of application is not important. See how you can apply early: How to apply early and benefit from the date of the ILR decision ?

The answer to that question on the form does not matter either. Your qualifying period is calculated based on the lawful residence you accumulated, not an answer on the form

Please I am currently considering a super fast track service that provides a one-day decision. If I engage this service, what date should I put in the application?
Can I make payment in early February and book an appointment from the 22nd of February?
Please would this be considered too early as am using the super fast track service, or it doesn't matter given my visa is still valid till July?

Also, an still abit confuse as you mentioned, "Your qualifying period starts from the date of entry to the UK".
Given I came to the UK on 14/04/2019, and I have not spent more than 180 days before coming to the UK, shouldn't the qualifying period start from 22/03/2019 as shown in the Biometrics and letter sent to me?

Am still confused on the date to put in my application as I intend using the super fast-track service and I am really looking forward in putting it in February. Please correct me if am wrong.

Did you read any of the advice given above ??
You need to calculate the date you are eligible for ILR as I explained. The qualifying period under the family route starts from the first entry to the UK, so you add 5 years to that and subtract 28 days. That is the earliest date you are eligible for ILR. That is the date your biometrics should be booked if you intend to apply using super priority service. Everything else is irrelevant.

Thank you for the advice. My first entry to the UK is 14 April 2019 which means as per your advice, the qualifying period to apply is 17th March 2024.

When I spoke to home office, I was told to minus 28 from the 22nd of March which is the date my visa was first issued.

Note that the UKVI immigration phone line is a third-party outsourced phoneline and be aware that they dish out incorrect advice regularly and we have seen lots of that here

Hi Zimba,

I spoke to an immigration lawyer and he confirmed the 28days should be counted backwards from when my entry clearance vignette was issued and not when i entered the uk which in anyway is less than 180 days. Also, i was going through your site and from the below link

The rules for tier 2 or skilled worker visas holders is not the same a a spouse visa holder. It is best not to confuse different routes and rules . It is not a one size fits all.

A spouse visa holders qualifying period for ilr starts from date of entry to the uk and not the visa issue date. This has alwasys been the case for spouse visa holders.

Ask the solicitor to show you the official documents from ukvi that states you can use entry clrarance issue date.

Also, there is no 180 day absence limit for spouse visa holders.

Can you clairfy ecavtly what category visa you hold and in what basis you applied for it, ie spouse if british citizen or........?

You said you are under the family route above. Do you know what the family/spouse route is or are you a skilled worker dependent?? The link you shared is NOT for a case under family route :!: We have now repeated multiple times that the family route is different

Also, the 28 days concession is relative to the ILR qualifying date so you will count backwards from that date. Counting backwards from the visa issue date makes no sense

Hello everyone, I would like to express my gratitude for the guidance provided thus far.

I am preparing to submit my application for the ILR spouse route, and the 28-day deadline falls on next week Saturday.

In order to make the most of the super priority service, I would like to inquire if it is possible to make the payment for my application today and schedule an appointment anytime from next week Saturday onwards.

Thanks for your advice. I made payment for my application a week before my 28days to my 5years anniversary on a spouse visa but booked my appointment within the 28days period using a super priority service.
Result was out in 4hours, and it was successful.
