MY SKILLED WORKER VISA GOT REFUSED AFTER VISA INTERVIEW

Post by avishekthapa2468 » Fri Mar 22, 2024 2:41 am

I got my skilled worker visa refused after the visa interview. I applied for Chef. Took 1 hour interview. Among 40 questions they mentioned some questions on my refusal. I answered them how I applied, my salary, my duties and responsibility, experience, qualification. Overall everything. Here is the questions:
1. What are the nine most common sources of food allergies?
My answer: It totally depends upon the person, peanuts, and dairy products, I am quite familiar with working in these situations and creating substitutions for those customers who have food allergies, totally dependent on the person, some people have certain fruits and vegetables.
Note: On this question, I didn't hear nine. So I just mentioned a few of them but I am very familiar with food allergies while working in my past days. My answers are right too as peanuts, vegetables, fruits, dairy products milk, curd, butter, cheese, ice cream, and yogurt are also some sources of food allergies. If I had heard nine sources I would have told them all of it.
2.In the UK what colour chopping board would you use for handling raw chicken?
My answer: I will use a yellow chopping board.
What color chopping board would you use for cooked meats?
I will use brown.
Note: As per the sponsor, they said they will give me Level 2 training no matter if I'm working as a chef. In our country, in my hotel, and in most of the other countries as well, we use a Yellow chopping board for raw poultry and a brown chopping board for cooked meat.
3.What is the name of the bacteria found in raw meat that causes food poisoning?
Answer: The exact name, I’m not quite sure
Note: When I studied for a diploma in culinary arts we were taught the exact name of the bacteria but as time passed we often forget so many things. I forgot the exact name of the time of my interview.
4. Have you applied for any other jobs in the UK?
Answer: No I haven’t
Note: Well, I told the interviewer that I did a lot of research before applying and found my sponser suitable for me as I am specialized in this cuisine and they are also restaurent specialising in the same cuisine. I found many other restaurants that were looking for chefs specialized in many
cuisines and there is no point in applying to those restaurants. I was being completely honest here.
5. How will you travel to your place of work?
My answer: Totally depends on the distance, if I’m nearby I will walk or get a bicycle or take a bus or train.
Note: Here my sponsor did not make me clear about the exact location of where I will be staying so, accordingly I answered that it depends upon the distance. But I mentioned my work address and accommodation address were the same i.e. 1X xxxxx Street, Stamford and said my sponser is providing the accomodation which is right.
At last interviewer asked is there anything you want to add and I said I want to work in UK as a skilled work and enhance my skill and build career but on my refusal as per interviewer I didn't added nothing. I am totally surprised.
Reasons for Decision
Your application has been refused for the following reason(s):You applied for entry clearance as a Skilled Worker under Appendix Skilled Worker
of the Immigration Rules. Your application has been refused because you do not meet SW 14A.1 (a), (b).To be granted permission as a Skilled Worker, you must genuinely intend, and be able, to undertake the role for which you are being sponsored; and not intend to undertake employment other than in the role for which you are being sponsored (or as otherwise permitted by your conditions of grant).
I meet 70 point and I am genuine candidate. What should I do next? Any help will be much appreciated. God bless you all!

Here is the refusal in written :
Reasons for Decision
Your application has been refused for the following reason(s):
You applied for entry clearance as a Skilled Worker under Appendix Skilled Worker
of the Immigration Rules. Your application has been refused because you do not
meet SW 14A.1 (a), (b).
To be granted permission as a Skilled Worker, you must genuinely intend, and be
able, to undertake the role for which you are being sponsored; and not intend to
undertake employment other than in the role for which you are being sponsored (or
as otherwise permitted by your conditions of grant).
After initial assessment of your application, you were invited to attend and interview
at the Visa Application Centre which was conducted via Teams video link on 12th
March 2024.
During the interview I note the following questions and responses:
Question Response
What are the nine most common sources of
food allergies?
It totally depends upon the person,
peanuts, dairy products, I am quite
familiar with working in these
situations and to create
substitution to those customers
who have food allergies, totally
dependent on the person, some
people have certain fruits and
vegetables.
What is cross contamination? Contamination is when the food
that is out of date or is covered by
any flies or sometimes while
working we get a hair in it, or
crossed expiry date. If the food
stays longer, after storing it that
happens, in that case the food is
contaminated.
Can you tell me some of the dishes included
on your sponsors menu?
They have an onion bhajis, spiced
okra, pilau, different biriyanis,

dumplings, these are some of the
dishes they have
In the UK what colour chopping board would
you use for handling raw chicken?
What colour chopping board would you use
for cooked meats?
I will use yellow chopping board.
I will use brown.
When preparing raw meat, how do you
ensure that it doesn’t contaminate other
food products?
I make sure the raw meat should
stay as frozen as possible, we take
it out of the freezer and cut it in a
separate place and once we cut it,
clean the chopping board and
knife, it has to be cooked straight
away.
What is the name of the bacteria found in
raw meat which causes food poisoning?
Some mucus or fugus, that’s what
we found. The exact name, I’m not
quite sure.
I note that your responses were very vague or incorrect, and you were unable to
answer basic questions regarding your role. You have stated that you have 4 years’
experience in your home country, therefore it would be reasonable to expect you to
be able to answer the above questions in more depth. You were unable to identify
the 9 most common allergies and the name of the bacteria found in raw meat. It is
reasonable to expect someone who has worked as a Head Chef for the last 4 years
to know the correct answers. Additionally, you were unable to correctly answer the
colour of the chopping boards used for raw meat and cooked meats. Again, it would
be reasonable to expect that a person who has previous experience and genuinely
intends to work and is genuinely capable of working as a commis chef to be able to
demonstrate technical knowledge regarding the role. Given the above, I am not
satisfied that you genuinely intend, and are able, to undertake the role for which they
are being sponsored.
AR refusal template – October 2020
You were also asked:
Question Response
Have you applied for any other jobs
in the UK?
No I haven’t
You also stated that you did not apply for any other jobs in the UK. Given the
competitive job market in the UK, I find it difficult to believe that you applied for only 1
job, were interviewed and awarded the job especially as I was not satisfied with your
technical knowledge responses. As such, I am led to question your motives for
applying for entry clearance to the UK and furthermore I cannot be satisfied that you
genuinely intend to undertake the role for which you are being sponsored.
In additions, you were also asked the following:
Question Response
How will you travel to your place of
work?
Totally depends on the distance, if
I’m nearby I will walk or getting a
bicycle or taking a bus or train.
How far is your place of employment
from your address?
I’m not exactly sure but I know it is
nearby
Given that you are travelling to the UK for the first time it would be reasonable to
expect you to have conducted research on the area and accommodation availability
that you will be employed in. The lack of any details further leads me question the
reasons why you have chosen to travel to the UK.
At the end of the interview, you confirmed that you understood all the questions, that
you were happy with the conduct of interview and that you were still feeling fit and
well and you did not have any other information to add. I am therefore satisfied that
you were given an opportunity to answer all the questions to the best of your ability.
Given all of the above, I am not satisfied that you genuinely intend, or are able to,
undertake the role for which you are being sponsored.
I therefore refuse your application under SW 14A.1 (a) of the Immigration Rules.

A lot of your answers to basic food hygiene are incorrect so i can understand the refusal. It miggt be that you did not fully understand the questions but if you have the claimed experience and training, these should have been very easy for you to answer correctly.

Have you taken the time to Google each question to understand where you went wrong?

Also it is very very rare that you apply for only 1 job and get it in the uk, even for those that work here. So how exactly did you get the job?

Did you use an agent to gain the role or are you related to the Sponsor?
There is something that the Home Office has picked up on. It is not a random act to invite individuals to interview.
