Child born outside UK

Post by Khan2805 » Sun Apr 28, 2024 6:13 am

Hi

Could you please respond to my querries

I am on skilled worker visa
I came to UK in 2018
My wife and son came to UK in september 2020 (son born outside UK jan 2020) as my dependents
I have ILR and due to apply for naturalization in august 2024

My wife and son will complete 5 years in august 2025.

My understanding is my wife will apply for ILR and can apply for direct naturalization without have to wait for 12 months ?

Can my son directly apply for naturilsation once my wife has ILR rather than having ILR first and then applying for naturalization ? To avoid ILR fees

In case its must for him to apply for ILR - does he need to wait for 12 months after ILR to apply for naturlaization ?

Any difference to my my grandsons in this situation like they cant be british by decent ?

Many thanks

Correct, once ILR has been granted.

Can my son directly apply for naturilsation once my wife has ILR rather than having ILR first and then applying for naturalization ? To avoid ILR fees
No, children born outside the UK are expected to hold ILR.

In case its must for him to apply for ILR - does he need to wait for 12 months after ILR to apply for naturlaization ?
No, there's no waiting period for children.

If grandchild is born in the UK will be "British otherwise than by descent", if grandchild born outside the UK will be "British by descent".

Many thanks

1. Your visa route when applying for Citizenship, either for yourself or your family, is irrelevant.

2. Citizenship LAWS rarely change and have been the same for a very long time. They are not as easy to change like immigration rules are.
