New 7-Year Child ILR Rule

Post by niranjanreddy » Tue May 07, 2024 8:22 pm

Hello All,

Both parents are on Skilled worker visa. New guideline says that "A child born in the UK who has lived there continuously for seven years can apply for settlement (ILR)".

Can parents also apply for ILR as soon as the child get an ILR ? Please suggest. Thank you.

There is no automatic 7-year path to ILR for children. The dependant children of migrant workers cannot benefit from the rules under the Appendix Private Life. The only beneficiaries are non-UK born children who have been granted leave under private life. Children of migrant workers will follow the same path as their parents and settle when both parents settle.
