Are the cheques deposited into an account and reflects name of the organisation/company/employer?cutegirl21 wrote: ↑Wed Jun 19, 2024 11:48 pmHello,
I have a few questions my husband's visa is expiring on 27 Sept 2024 and he is due for ILR. I have a few questions. We have to rely on only my husband's income.
1. My husband started a job in a company on 5/3/24 and his package is £24k per annum, I hope it still meets the threshold and he will be considered in the old threshold of £18.6k per annum. Yes old
2. His employer was giving him a salary in the form of CHQ and we just saw the guidance and it said amount should come from the company to personal account so he spoke to HR dept of the company today they agreed that the salary of April & May they can deposit this week my question will that be a problem can home office raise a concern why salary of April & May comes like this recent week and June salary will come in to account as normally end of month. I tried to find the rules but cant see anywhere that period month salary should come same month. Anyhow I have original payslips from the company and I have an employment contract and appointment letter as well. His tax has already been submitted for March April May to hmrc.
3. If the salary comes in our Joint account will that be fine, or does it need to be in his solo personal account? No problem with joint account
4. How long a bank statement do I need to send I believe I will need to send only from 15 June till 27 Sept I don't believe I need to send a six-month statement, as I saw the rules mentioned send that period when your salary came ? 6months
5. I was planning to send the recent six months' salaries from April to Sept as sept payments I believe latest it will come one day before his visa expires, what do you recommend will they accept sept payslips or shall I send March to Aug Payslips. ? Covering 6months period Sept.
Thanks in advance..
- (a) Payslips covering:
- (i) a period of 6 months prior to the date of application if the person has been employed by their current employer for at least 6 months (and where paragraph 13(b) of this Appendix does not apply); or
- (ii) any period of salaried employment in the period of 12 months prior to the date of application if the person has been employed by their current employer for less than 6 months (or at least 6 months but the person does not rely on paragraph 13(a) of this Appendix), or in the financial year(s) relied upon by a self-employed person.
- (b) A letter from the employer(s) who issued the payslips at paragraph 2(a) confirming:
- (i) the person’s employment and gross annual salary;
- (ii) the length of their employment;
- (iii) the period over which they have been or were paid the level of salary relied upon in the application; and
- (iv) the type of employment (permanent, fixed-term contract or agency).
- (c) Personal bank statements corresponding to the same period(s) as the payslips at paragraph 2(a), showing that the salary has been paid into an account in the name of the person or in the name of the person and their partner jointly.
- (d) Where the person is a director of a limited company based in the UK, evidence that the company is not of a type specified in paragraph 9(a). This can include the latest Annual Return filed at Companies House.
- (e) Where a person appointed as a non-executive director of a limited company based in the UK, which is not a company of the type specified in paragraph 9(a), is paid a fee instead of a salary, this income may be treated and evidenced as though it were income received for employment in that capacity.
