ECS check by Employer!! URGENT HELP NEEDED

Post by Ines_2469 » Fri Jul 19, 2024 10:40 am

Hi

I really need info in regard to ECS check. I had my fee waiver rejected recently and within given 10 working days, I submitted a paid application but my biometrics are due for sept 5th. Meanwhile, my Employer wants to check for ECS again to see if I have right to work. Previous to my fee waiver rejection I got positive ECS with right to work valid till Dec 2024, but now I'm worried if I'll get the same outcome as my biometrics are yet to be submitted.

Can anyone from the community kindly let me know what might the ECS result be please? Does ECS depend on application submission or it results in positive only after biometrics are given? Please HELP, I really need this info. It is going to effect my job. I'll be grateful for all your support. Thanks.

Is your BRP still valid? Did you make an on time application?
No sin in failing, you just have to try and try again!

Hi @ticktak

No, my brp was expired. Before it was due to expire, I dropped a fee waiver application and during that time my ER has requested for a ECS check which came out positive and valid till Dec 2024, but recently I got my fee waiver rejected, and was given 10 working days to drop a paid application and I did so. But now, my Employer again wants to go for ECS check to verify my right to work, however I'm worried as I might get negative before I give my biometrics that was scheduled on Sept 5th.

What visa did you hold that has expired?

Did you submit a fee waiver just to buy time? How do you believe you qualified for a fee waiver?

Hi @CR001

Thanks for your response. I was on Graduate visa previously and working as a Data Analyst. Initially my manager told that they will provide sponsorship after few months and by the time my visa was due to expire, the new law started circulating in regard to new salary requirement, though I qualify that, the organisation has came out with rules in regard to Tier 2, where they would sponsor only for salaries above 60k, so I had no other choice and to buy some time I applied for fee waiver, in mean time my boyfriend got his Tier 2 visa approved, so after my fee waiver got rejected I immediately applied as dependent on his visa. Now, I got to give my biometrics on Sept, but worried about ECS checks in between. Please let me know if they would consider in time application or biometrics thing in order to verify right to work checks and ECS response. Thanks again.
