What happens to the dependant visa when the main applicant gains ILR

Hello,

I am living in the UK with my wife. My wife has a Tier 2 visa and I am a dependent on that visa.

Her visa and mine are valid until mid 2026.

She has qualified for ILR and we want her to apply for settlement as soon as possible. I, however, have not completed my 5 years in the UK yet (I was on a different visa at the begining and only moved onto her visa as a dependant later). I need another year before I qualify for ILR.

My question is, what will happen to my visa if my wife applies and is granted ILR. Will my visa be valid until the current expiry date in 2026? Or do I need to apply for an extension/updated visa?

Nothing happens to your visa. It remains valid.

Are there any documents from the Home Office about this? I found some guidance here but it's been withdrawn in 2021.

It is stated in the immigration rules and 100s have not had any issues!

Unsure why you think your visa suddenly becomes invalid.

My concern is that my visa is that of a dependant of a Tier 2 visa holder. Once she's on ILR she's no longer a Tier 2 visa holder, and my visa as a dependant of a Tier 2 visa holder might lose meaning.

As far as I know my visa is dependant on my wife's visa.

In a different scenario, am I correct in assuming if she lost her job (and was unable to get another one), my visa would be invalidated along with her's before the end date on the visa?

I was worried that she changing visa category will have a similar implication.

You are overthinking completely.

Your current visa remains valid if she gets ilr.

If she loses her job, curtailment can take a while, so don't stress about something unlikely to occur imminently!
