ILR - 7 years Child Route

Post by Shov83 » Sat Aug 10, 2024 6:04 pm

My kids have been completed 5 years in Aug'24 in the UK on dependent Visa of Father, now they are moving on mother's dependent Visa. Would my kid be eligible for ILR-7 years child route in Aug'26? My kid will be going into university in Jul/Aug'26 and will be entitled to apply as an UK student.

There is no 7 year ilr route for skilled worker dependent visa holders

They qualify for ilr when both parents do.

There is no shortcut route.

There is no automatic 7-year path to ILR for children. The dependant children of migrant workers cannot benefit from the rules under the Appendix Private Life. The only beneficiaries are non-UK-born children who have been previously granted leave under private life routes. Children of migrant workers will follow the same path as their parents and settle when both parents settle, as advised

Unless child was born in the UK, which is likely not the case here.

Even in this case, it would not be unreasonable for the child of migrant worker to leave: viewtopic.php?t=332032#p2085943
