ILR financial requirements

Hi,

I am a newly qualified pharmacist, this is my second year on Tier 2 skilled worker visa.
I have applied for a visa (with 2 other dependants) and been granted the visa for three years.
I have decided to work 3 days a week (due to childcare reasons)
That would be 24 hours. My hourly salary is around 22 pounds an hour, and my annual salary is 27000. All this was mentioned in my CoS and I got the visa for three years.

When I was looking into the ILR application in future, the financial requirements says going rate of the job, which is 35000 for 37.5 hours. Can someone pls guide me if I'm eligible, is it pro rata basis, or should I increase my working hours.

Tier 2 route does not exist and this has been the case for several years, so you are under the skilled worker route. This is important to emphasise to avoid confusion as many old requirements under Tier 2 General no longer apply and the rules have changed (in some areas pretty significantly)

Salary requirements under your SOC are often based on 37.5 hours per week. You need to pro-rate this based on your working hours to see if you still qualify, so your pro-rated min going rate will be £35,000 ÷ 37.5 x 22 = £20,533. However, you must also meet the general threshold for ILR which could be higher than this.

Note that this is based on the rules for ILR as they currently stand and the rules could change in the future.

Regarding the general threshold, it says 29000 but could be less for Health and care ASHE jobs. Pharmacist is one of them. So will 27000 be alright?
If I have been granted the skilled worker visa, does it make me eligible for ILR if my contract remains unchanged.

"The general salary threshold of £23,200 (option K) is also available to individuals who are applying for a salary and a job in a listed health or education occupation, listed in Table 3 of Appendix Skilled Worker"

From what I understood, pharmacists SOC 2251 is listed in Table 3 and 23,200 is the threshold.

Please correct me if I'm wrong

Will you please check for me if job with SOC 2251 (Pharmacist) has the minimum salary threshold as 23,200 pls?

What relevant band are you being paid under, and where are you based ?

My CoS states band 6 and I'm in England.

Then your going rate for a 37.5-hour work week is £35,392, so for a 22-hour week it will be £35,392 ÷ 37.5 x 22 = £20,763. However, the general threshold is set higher at £23,200 £29,000 which is what you need to be paid.

I greatly appreciate your help.

If that is the case, can i do a locum work, meeting the requirements of extra work (same job code and less than 20 hours) and my primary income and the extra work as well to meet the ILR requirements? Is it allowed to add the salaries of the primary work and supplementary one to meet ILR?

You cannot use your second 20 hour per week job to meet the Skilled Worker salary threshold.

You can only use your main Skilled Worker job salary. Your second job is irrelevant for the the salary requirement for ILR.

May i clarify this with you.
1. From the document that was shared in the forum, this is what i could read:

"Occupation codes in Table 3 of Appendix Skilled Occupations
Salary Casework action
At least:
- £23,200; and
- the full pro-rated going rate - award 20 points for a job in a listed health or education occupation and salary (option K)
The general salary threshold of £23,200 (option K) is also available to individuals who are applying for a salary and a job in a listed health or education occupation, listed in Table 3 of Appendix Skilled Worker"

My occupation (SOC 2251) is under this table 3 and option K. So is the threshold not 23,200 or am i missing something? Please correct me if I am wrong.

2. One last question to conclude, this financial requirement has to be met all through the 5 years, or should i meet it only the year i am applying for ILR, i think its silly.

1. Yes you are correct that the general threshold is set at £23,200
2. This is just the ILR requirement. This is what you need to be paid when you want to apply for ILR. You only submit your latest payslip for ILR
