how to apply ILR depedant application when they have 180 days beak (Outside UK living)

Post by rajesh57 » Mon Oct 07, 2024 4:16 pm

Hello,

I am the primary applicant and I began my Skilled Worker Visa on October 14, 2021. I currently hold a valid Skilled Worker Visa until November 14, 2026. After completing five years on this visa, I will be eligible to apply for Indefinite Leave to Remain (ILR).

My spouse and child also started their Skilled Worker Visas on October 14, 2021, but they had a break of 180 days outside the UK. They spent approximately one and a half years in India.

They returned to the UK on November 28, 2023. This means that they must complete five years on the Skilled Worker Visa before becoming eligible to apply for ILR. My question is:

Once I (the primary applicant) apply for ILR in November 2026, is it possible to extend my dependents' visas (my spouse and child) as ILR dependents until they become eligible for ILR? Since my spouse and child returned to the UK on November 28, 2023, they will need to remain on the Skilled Worker Visa until November 28, 2028, to complete the required five-year period.

I found a relevant link, but I couldn't locate any options to apply for ILR as a dependent. Could you please assist me with this matter?

They apply to extend their skilled worker dependent visas. It will be a 3 year extension.

They apply on form SET O for ILR when they meet the requirements.

Thanks for your reply. I am not sure how I can apply for Skilled worker dependant visa for my family if I apply for ILR in Nov 2026. Post which I won't be qualified as a Skilled worker. So I am just trying to understand what kind of visa I need to apply for my family once I get ILR

The rules allow them to continue extending their Skilled Worker dependent visas when you get ILR!! 1000s have done this.

They are NOT dependent on your skilled worker sponsor. They are dependent on YOU.

That's great. I was under the assumption that it was not possible . Thanks a lot for clarifying

So is my understanding correct that I would need to use the usual Skilled worker dependent route ?
