Baby Born in the UK Citizenship

Hi all,

I hope you are well.

I was recently granted ILR and my wife is still on dependent visa and would continue for 3 more years to become eligible for ILR. My question is regarding my son. He was born before I was granted ILR and now I'm wondering do I have to apply for his visa as an dependent with my wife or can I apply for his citizenship directly i.e without applying for dependent visa first and does he has to spend 5 years as well to become ILR eligible and then citizenship etc?

Hi,

I'm filling application for my son's Citizenship and I've reached the point of adding 2 referees.

The 1st referee I've arranged is my wife's uncle who is British Citizen and is above 40. My son is only 2 years old so 3 years of knowing him doesn't apply.

I have doubt about my 2nd referee and hence the reason for replying to this post again.

We couldn't arrange any professional who would provide us a referral. We tried our surgery and they say they don't do it. We've now asked one of our family friend who knows and is British Citizen as well and is above the age of 25 years. Her designation is HTLA (Higher level teaching assistants). Will this be okay and will work as second referee?

Please reply and thank for helping us before as well. We really appreciate this forum and the help it offers.

You cannot use someone who is a family member, either by blood or by marriage, so an Uncle won't work. Find another referee.

For children, it is less of an issue re professional referee. You can use someone you know and write a brief covering note.

Thank you for your valuable help so far.

We've applied for our son's citizenship and are collecting docs to upload to TLS. We've asked 2 of our family friends who are British Citizens to give us references. I've downloaded the referee forms and since I'll be uploading them so digital photo and signature of the referees would work, right?

Because I was reading on another thread that the referees must write name etc on the back of the photo before sticking it on the form and send it but when I finished the application they asked me to upload the docs so I'm assuming digital photo and signature would work? or have I missed some step or information?

Ignore the requirement for name etc on back of photos. That’s a left over from the paper application process.

One of teh referees should be a professional from the approved list.

One is a sales assistant at JD.
The other one is HLTA teacher.

Will these work?

is the teacher member of a relevant professional body? if so it's OK. the other one must be over 25.

Thanks for the reply. You reply got me thinking and I've been doing a lot of research on the internet about HLTA and it is an assistant teacher job and now I'm not sure whether this would qualify as professional or not. I've read on another forum that assistant job wouldn't be treated as professional.

Is it possible to change the referees? My son's fingerprint date is 4th November so I still have time.

Does both the referees need to know the applicant for 3 years?

I'm thinking about adding a new professional referee and would move the HLTA as 2nd referee since she is 25+ years old.

Just ask your friend if they are a member of a professional body or not. You can change the referee if your first choice isn't suitable. Both referees should have known you for 3 years.

Just pick a different referee, get them to sign the form, and explain in a cover letter.

Hello,

I've arranged 2 different referees now and have collected all the data needed. One of the referee said that he needs to sign the back of the photograph as well but I said since I'm uploading the docs online so that is not needed.

Just to be sure, I'll be only uploading the docs on the TLS website and on the day of fingerprints do I need to bring the referees form in hard form (with photograph signed on the back) as well?

no, only upload them. it is a relic of pen and paper days, the form hasn't been updated.
