New Born baby status during ILR Application

Post by prreddy » Wed Oct 16, 2024 10:07 pm

Hi. I’m planning to apply for ILR via Skilled worker route for myself and my wife.

We have a 2 months old baby. She doesn’t have any visa status at the moment.

My questions are:

1. Do we need to add our baby as dependant along with our application? Does she need to be visa compliant while our application is under process?

2. If we do not make her application as dependant with our application, is she eligible to apply for naturalisation once we receive our ILR? Or will we be able to apply for her British passport directly?

Thank you.

If she is born in the UK (that is not clear from your post), then she is entitled to register as a British citizen after either one parent is granted ILR.

No, you can't apply for a British passport for her directly, as one of the parents did not have ILR at the time of her birth.

Thank you for your reply.

Yes. She was born in the UK.

Can she apply for British passport directly after one of us receive our ILR?

No, she is not British. Only a British citizen can apply for a British passport. You have to register her as British first on form MN1 and once approved and you have the registration certificate, only then can you apply for a passport.

You have already been advised of this.
