LR route and 5 year skilled worker route for dependents

Post by irfaansb » Wed Nov 13, 2024 11:18 am

Hi, I came to the UK in July 2015 on a short-term ICT visa (1-year visa valid from 1st Feb 2015 to 31st Jan 2016).
I left UK on 25-01-2016.
Later, in April 2016, I applied for a long-term (3 years) ICT visa and Traveled to the UK on 22nd May 2016. I applied for an extension in the UK after a year (in 2019). My visa was extended until 22nd May 2021.
I applied for a Skilled worker visa on 10th May 2021 and got a 5-year visa until 4 June 2026.

Question 1: Am I eligible to apply for ILR in May 2025? in Long residency route (10 year continuous residence)?

Dependents:
My daughter born in the UK - Feb 2017.
My wife does not have continuous residence. She and our first daughter were out of the UK from June 2018 until August 2019.
2nd Daughter was born in India on Nov 2018.

We all have been living in the UK since Aug 2019 (Long term ICT dependent visa and Skilled worker dependent since May 2021).

Question 2: If I get ILR through the Long residence route, can my dependents (Wife and second Daughter) be on Skilled worker dependents and apply for ILR in June 2026(5-year route)?
Note: Elder daughter will qualify for citizenship as she born in the UK and I will hold ILR.

Question 3: Else we all (Myself, wife and younger daughter) apply for ILR in June 2026 through 5 year route skilled worker visa?

1. Yes you are eligible
2. Yes. They can stay as skilled worker dependants and qualify after 5 years.
3. That is also possible but that delays your ILR and your UK-born child's citizenship registration

Thank you for the response. I have one follow-up question, though. If my dependents continue to be on the skilled worker visa after my ILR, can I change my job without sponsorship? Also, are there any issues if they re-enter the UK after a vacation?
