British citizenship for dependents of Skilled Worker

Post by Sara44 » Sat Nov 23, 2024 10:55 pm

Hi All,

Thanks a lot for all your valuable advices.

I came to the UK as a Skilled Worker on 2018, and obtained my ILR in September 2023. My partner and child joined me later as defendants on 2019, and both received their ILR two months ago, in September 2024.

I was granted British citizenship through naturalization last week November 2024.

My questions are:

1.when can my partner and child apply for British citizenship, and under which route?

2. Can they apply now, or do they need to wait for 12 months?

Thanks in advance

If you are married the the partner can apply under 6(2) without waiting 12 month. The child can apply under discretion, see MN1 guidance children applying inline with parents.

The residency requirement is 3 years for the spouse and 2 years for the child. The child must be minor.

Have you attended your ceremony already or have you only received the approval email?

Both spouse and child can apply already.

Thank you so much,

One more question,

in such case, will child get (British citizenship by descent) or (British citizenship otherwise than by descent)?

Child will be "British otherwise than by descent" - not sure why you are asking - you are in the UK.
A child born abroad to a British citizen will be "British by descent" - this doesn't apply to you.
