3 FLR (FP) and 1 FLR(M)

Post by peeta » Sun Jan 19, 2025 1:23 pm

Hi,

I have a friend who applied dr FLR (FP) in Jan 2015 under 10 year route and since then had 3 FLR(FP) and a one FLR(M) due to end in 2026.

My question is, since his first FLR(FP) application was made in Jan 2015 (but was granted in June 2015) - is he eligible for ILR now (Jan 2025)?

thanks

What was their visa status before applying for and being granted the first FLR FP visa?

If no visa status, then for 10 year long residence it starts from when rhe first visa FLR FP visa was granted, not when they applied.

thanks cr001 for the prompt reply.

they were on a entry clearance visa, so they become eligible for ILR in June 2015 under long residence or under the 10 year Family and Private Life route they were initially granted in June 2015?

reading here https://www.gov.uk/indefinite-leave-to- ... ily/parent

I see
If you’re on the 5 year route and your partner is settled in the UK
You cannot apply for indefinite leave to remain as a parent if you both:

have a partner in the UK
are eligible for a partner visa

so, even if they are eligible for FLR(M), they can't apply for ILR under 10 year rule?

They can apply under either 10 year route

The qualifying period for both starts from the date when the very first visa was granted. I am not sure where you got an idea of the possibility of them applying now. Time spent waiting for an application does not confer any form of lawful residence unless while they were waiting, they either held a valid visa on some other route or they had extant leave under section 3C.
