ILR SET (M) Queries - Split applications for Spouse and Children

Hello all,

Please see immigrations status for my family members as below
OP : British Citizen by Naturalization in 2012
Spouse: Partner Dependent Visa. Extension 2 valid until Oct 25. Qualifying for ILR on 5 year route in Dec 24 Children : Born outside UK, when Father was on ILR. Currently on Child Dependent Visa in line with Spouse. Extension 2 valid until Oct 25. Qualifying for ILR on 5 year route in Dec 24

We have started collating documentation for the application. We have decided to apply for my wife first and then apply for children after 3-4 months (since they have visas till Oct 25), to mainly spread out the cost.

For financial requirements, we are planning to use cash savings.

1. So my queries are, since we are currently only applying for my wife, we need to show proof of funds for £34,600 right? Or do I still need to factor 2 children and if so, what is the amount we need to meet requirements?

2. Also, funds in a Cash ISA (can be liquidated straightaway) are ok to be used to meet financial requirements?

3. And finally, can we use the Priority service (£500 extra for a decision in 5 days) with SET (M) applications?

1. You still need to factor in the childrenas rhey hold visas. Read Appendix 1.7 financial requirements.

2. ISA is fine.

3. The 5 day priority option is not available for SET M. You only have the option of standard or super priority (£1000).

1. I had gone through the links for financial requirements but it was all a bit confusing. Anyways, my understanding is, we need to show 18,600 + 3,800 + 2,400 + 16,000 = £40,800 in funds, correct?

2. Also, should I explain in cover letter, why we are only applying for the wife and not the kids? Or is this not needed?

3. And for this question
Do you and your partner currently live together? (Required) - Yes
When did you start living together? - What date should we use? Our marriage date (2010), since when we started living together or the date when they joined me in the UK (2019).

4. I should mention my 2 children here, as they are not applying on this application?

"You should tell us about any additional children they are sponsoring who need a different type of visa to enter or remain in the UK

Do not include children who are:

dependants applying on this application
over 18
British Citizens
settled in the UK
EEA nationals with a right to reside in the UK under EU law"

Hello experts,

Appreciate if someone can respond to my questions above, especially the first one regarding cash savings - whats the correct amount to show? Also, if the savings are just over time from earnings, do we still need to show any sources?

For cash savings, you need £34600 + £3800 (per child) maintained for at least 6 months in your account. Yo do not need to show any sources

Thanks to all experts here. Applied for SET (M) for my wife under Super Priority and received it next day.

As per advice from experts on this forum (apparently direct citizenship is not possible despite both parents being settled), will apply ILR for children.

My question is, do we still need to meet financial requirements and submit other evidence like bills for residence? (in case of children, not sure what address proof's I can provide) etc

Why the children were not included ?
Children will have to settle using form SET(F). There is no financial or address proof etc requirement at all

Children were not included as I was under the assumption, we could apply for citizenship directly, as they have competed 5 years and have visas until Oct 2025. Also, after my wife's ilr, both parents will be settled. But it seems this approach will not work.

And in terms of fees, I couldn't afford fees for all 3 applications at once, so decided make staggered applications.

To confirm, next steps are apply for children using form SET(F). Want to mention, they were previously with wife on 5 year settlement route as family of British citizen - just double checking SET (F) is the right form?
