Fiance visa on pre settled status

Hi

I will be marrying an eea with pre settled status
What will be my status ?

Do I need to apply for spousal visa
Plus what be my status
Just on spouse visa of like wife of British National
Or I will get pre settled status too ?

Will this lead to settled status after 5 years when he also gets it or he will get before me

You have to apply for a spouse visa, which is a visa for 2.5 years and pay the visa fee and the immigration health Surcharge.

Before that visa expires, you have to apply for a 2.5 year extension and pay rhe visa fee and immigration health Surcharge again.

When you get to 5 years, you apply for Indedinite Leave to Remain, paying the fee,currently almost £3000.

For each step there are financial and English requirements that you must meet.

You also need proof of your divorce with a court issued decree absolute before you can marry and apply for a spouse visa

Pre settled and settled status doesn't apply to you.

What is your current uk immigration status?? What happened to your set DV application? Are you still abroad?

My set dv application was withdrawn as I left UK
The one made outside was also refused
I went back to apply again and only applied for DDVC which was refused
Didnt have the funds to remain there and apply for ILR again
All in all no application now and nothing left out of it

Plus the person with pre settled status can they apply the spousal visa

Do you have a valid visa now or not?

Divorced but pending phase of application as I left the UK

The previous spouse has already married

And now I am looking for marriage too

What exactly do you mean by "pending phase of application"??

How long have you been in a relationship with the EU citizen?

Do they work and meet the financial requirements for a spouse visa of £29,000pa for at least 6 months?

Do you meet the English A1 test requirement?

Have they sponsored a spouse previously? If yes, are they also officially divorced?

You have to apply in your home country. The EU citizen can't apply for you in the uk.

I would expect any application you make to be scrutinised given the multiple applications you have made to try to stay in the uk and which have been refused.

There was a court order I received which I had to sign and refurn etc etc which I have not done

To get a fiance or spouse visa, you are expected to have met in person and be able to showing relationship evidence.

He was put an objection on his pre settled status because he travelled to another European country for long
Now his passport is submitted and with home office
How long can this take and will he be succesful
