Child of ILR holder currently in India

Post by samkma » Mon Feb 10, 2025 12:05 pm

Can someone point me to the visa application that needs to be made for the child of an ILR holder whose child is currently in India?
Child was born in the UK but travelled to India after 3 weeks, travelled with an Indian passport, and never applied for a UK visa while here in the UK. The parent with ILR is the sole surviving parent.
1. Is it Appendix FM child
or 2. Family visa

There is only one visa application you can make.

Appendix FM and then complete form Appendix 1.

You can of course also register the child as British on form MN1.

Appendix FM (Child) takes to this application "Apply to enter the UK as the child dependant of a parent who is applying for (or already has) permission to be in the UK as a partner"

Where as the the application that says apply online states "Non-British child of a parent, parents or relative
who are British citizens or settled in the UK"

As I complete this application it is asking for parent details as below (which is not right in my situation)
Give details about your first parent
Give details about your parent who is currently applying for (or already has) limited leave to enter or remain as a:
partner of a settled person; or
      parent of a settled child

What is this person's relationship to you?
