Wife eligibility for Naturalisation under 3-year route

Post by durga » Wed Mar 12, 2025 12:21 pm

Hi,

I'm confused about the route my wife should be taking for naturalisation.

Here are a few details:

I came to the UK on a Tier 2 ICT long-term visa in November 2010.

We got married in February 2015, and my wife came to the UK on a Tier 2 dependent visa in April 2015.

I applied for my ILR on the 10-year route in October 2020 and it was approved in March 2021. I received my naturalisation in June 2022.

My wife applied for FLR-M in January 2021, which was approved and is valid until August 2023. She then extended her FLR-M until March 2026.

She applied for ILR through the 10-year route in March 2025 and is currently awaiting approval.

Regarding my wife's absences, she has not been outside the UK for more than 90 days in the past year, and she has had no absences totaling more than 270 days in the last three years.

Can she apply for naturalisation immediately after she receives her ILR and after June 2025 under the 3-year route as the spouse of a British citizen?

Thanks.

Yes. Route to ILR is immaterial for naturalisation (both yours and hers) as long as she is granted it. Note there are other requirements she has to satisfy too.

Thanks for the response contorted_svy.

Do you mind sharing what the other requirements are, aside from the Life in the UK test, the English language requirement ( passed B1 test used it for FLR-M application), and absence limits?

Other requirements are being of good character, being over 18 and of sound mind, being physically present in the UK on the first day of your qualifying period.

She will need to submit your marriage license, your own passport/nat certificate to prove you are British, proof of ILR, two referee forms, her own passport(s) covering the last 3 years.

Thanks @contorted_svy.

I have another question regarding the timing for applying for my wife's Naturalisation. If she received her ILR in May 2025, can she apply for Naturalisation right away, or should she wait until June since I received my Naturalisation in June 2022, even though we married in 2015?

She can apply as soon as she gets ilr provided she meets the 3 year requirements.ents.

It doesn't matter when you became British. The requirements.ent to apply without waiting 12 months is simply that the person is married to a British citizen when they apply.
