Dependant Visa query

Post by tapaspan » Mon Feb 24, 2025 9:46 pm

Main applicant is ILR holder whereas his family Visa (through Tier2 Skilled worker route) is expiring in May,2025 and family is in India now. They are not thinking of continuous stay for ILR eligibility, at least for next 1-2yrs. In this situation, need your advice on the below two scenarios:
Scenario1# Visa application from India: Family can apply for dependant visa after current expiry. This will be treated as a fresh new dependant visa and every time this will be renewed for 3yrs.
Scenario2# Visa application from the UK: If family comes to the UK and apply dependent Visa extension from the UK before current Visa expiry. This extension will also be done for 3yrs period. In this case, continuity of Visa will be maintained, but wont be of much help as they will not fulfil the stay requirement for ILR.

Are the above understandings correct? Only difference I see for extending the Visa from the UK (in scenario#2) will help maintaining the continuity. If we are not planning for family ILR soon, then we can go for any scenario, or are there any points that we should think of? Please advise.
P.S: we don't want to consider the tourist visa option

If they do not care about ILR, then it does not matter what route they take

Thank you for your response. When they have decided for long term then we have to consider for continuity, right? Till then we can get their dependant visa done for 3yrs duration.

Thank you so much for your response. One last thing, when my family apply for a fresh dependant Visa, what would be the visa category in this case (when the main applicant in ILR status through T2 skilled worker route)?

It depends on if their current visas are already expired and if they are in home country. If their skilled worker dependent visas are already expired, I believe they can then only apply as spouse/child of ILR holder, spouse visa, meeting the English and Financial requirements.

Thank you. I am bit confused on the above response. In my case,
My family's T2 Dependant Visa expired and they went back to their home country. Meanwhile, primary applicant got ILR. Now, my family wants to apply for a fresh dependant Visa, which category they should apply? dont see any category for 'ILR Dependant' in the gov.uk website.

There is no such a thing as ILR dependant. If their dependant visas have run out, the can return by applying under the family visa route.

Thank you. so would it be different than "Skilled worker dependant visa" (primary applicant got ILR through 5yrs T2 skilled worker route)? do they have to go for English test this time? and how long this visa would be valid? Please help me to understand this.

Your spouse needs to meet the English requirement yes.

You need to meet the financial requirement for a spouse plus dependent children with a minimum of 6 months payslips and bank statements plus an employer letter.

The visas will be valid for 2.5 years.
