Query related to ILR application for Self and Dependents

Post by tanves » Sat Mar 15, 2025 4:09 pm

I had originally come to the UK on a Tier 2 ICT visa and arrived in the UK with my family (self+spouse+2kids) as dependents on 16-Apr-2016.

I continued to stay in the UK on a Tier 2 ICT visa through extensions of the visa - I had 3 extensions in total.

My company started my switching to skilled worker visa processing formalities in December 2020. I also had a baby in the UK in December 2020. My company suggested that I continue with processing my visa without the newborn added as a dependent as I would need to get their birth certificate, passport, etc. documentation to apply as a dependent. Suggestion was to apply for the baby's dependent visa subsequently once I had their documentation ready.

My switch to Skilled Worker visa was completed with Biometric submission done on 18/Feb/2021 and BRP issue date of 03/Mar/2021 for me and my dependents (wife+2kids). The CoS was requested for a 5 year period so my application was for stay until 17/Mar/2026.

I then resigned from my 1st company and joined another company in 2022. The skilled worker application that I made with this company included my new born baby so it was an application that covered myself+dependents(wife+3kids). Again, this skilled worker application was for a 5 year period with the BRP's getting issued on 18/Feb/2022 for all applicants. The leave to remain on this application was valid for all dependents and myself until 7/Feb/2027.

I then resigned from the second company and joined my third company on a skilled worker visa in September 2023. This time around, I only made an application for myself as my dependents already had leave to remain valid until 7/Feb/2027 on my previous skilled worker application. I had confirmed this with the company solicitor who helped with the visa application that I didn't need to apply for my dependents as they already had valid leave to remain and I had already paid for their IHS and application fees twice now. My latest skilled worker application was for a 3 year period and the BRP was issued on 14/August/2023 with an expiry of 08/October/2026.

All my applications have been in-country applications and I have never stayed outside of the UK for more than 4 weeks at a stretch with a total of just 60 days of stay outside UK in the last 5 years.

My questions are:

1. When is the earliest date when I can apply for ILR? I am assuming this to be 03/Feb/2026 (5 yr - 28 days).
2. Will I face any issues due to the new born baby dependent application done a year and bit later when he was born?
3. Will I face any issues with the dependents not included on my last skilled worker application?
4. Can I apply for ILR for my dependents along with myself on the earliest date?

Thank you @zimba!

Just one additional query, I have come across an option where I could leave my kid born in the UK out of my ILR application and then straightaway apply for their citizenship status once I have my ILR.

Just wanted to confirm if this is correct and that I can leave out my kid born in the UK off my ILR which will be for myself+wife+2kids. And then once my wife and I have our ILR's we can apply directly for citizenship using form MN1 for our kid born in the UK.
