Conversion from presettled to settled automatic now?

Conversion from presettled to settled automatic now?

Hello,

In July my non EU wife will have 5 years of residence in the UK. She worked full time during this period. I have gained British citizenship in the meantime last year, but kept my EU citizenship. As I read, now all eligible presettled will be automatically converted to Settled Status? Should she wait for that which is easier or she needs to apply for the Lounes route?

She has to apply for settled status. If she does not, she will automatically get another pre-settled status for 5 years, as stated on UKVI's website.

Convert pre-settled status to settled status
You may be eligible to convert pre-settled status to settled status if:

you’ve lived in the UK for 5 years in a row
you meet the eligibility requirements
You can apply for settled status if you’re eligible. If you do not apply, your pre-settled status will be extended by 5 years just before it expires. You’ll be sent an email telling you when this happens.

The Home Office may move you from pre-settled status to settled status automatically after your pre-settled status is extended. You’ll be sent an email telling you the Home Office is considering automatically converting your status. You’ll get another email telling you whether or not your status has been successfully converted.

I don't have the UKVI link - but as I understand it is not a blanket conversion.

The very first link on that webpage leads to page that states;

Not necessarily. The Home Office have announced that at some point in 2024, they will start offering automated upgrades to some pre-settled status holders. We have created a Q&A document, with a detailed list of questions that will hopefully answer questions you may have. The document is available here.

We continue to encourage anyone with pre-settled status to make an application for settled status as soon as they are eligible to do so
The OP's spouse is a Lounes case, which is processed separately and differently (because it is a paper application and not an online application).

I would suggest making the application as soon as they are eligible and not assume that an automatic conversion would kick in.

I need some advice regarding my sister's status who was granted pre settled status under the Surinder singh route as a non EU family member (spouse) of British husband. She will have been in the UK for 5 years soon.
When she applied for pre settled status it had to be done via paper application. Just wondering if its the same process now or if would need to apply online for settled status?

Yes, she needs to contact EU Resolution Centre and request a paper form, fill it and send by post with all relevant documents.
