Spouse visa extension - new baby

Hi all,

My wife, from Pakistan, was granted a spouse visa in 2024 under the previous financial threshold of £18,600.

I understand that we must apply for a visa extension within 28 days of the spouse visa expiring.

My questions are:

1. If we have a child prior to any application for an extension being made, are we required to add that child as a dependent in the extension application?

2. If so, what would be the threshold that we would need to meet (£18,600 + ? per child).

3. Would be need to pay for the healthcare surge charge per child?

4. If so, how much would this be per year AND what would the TOTAL be for 2.5 extension?

5. Would we need to apply for a British passport for the baby even if the baby does not have British nationality (until 7 years is it – please can someone confirm or advise on this?).

6. After 2.5 years, we would apply for ILR for my Mrs (following a total of 5 years stay in the UK). My question is, what does this mean for the baby. Do we apply for ILR for the baby or an extension again with healthcare surgecharge (for another 2.5 years)?

This is super confusing for me and I would be the most grateful person for anyone who can share light on this and even someone who has gone through the exact same process (ahead of us).

What is your UK immigration status? Where is the baby born, in the UK or abroad?

Thanks for getting back to me - really appreciated!

I am a British national, born in the UK. Our child will be born in the UK too.

My Mrs has entered the UK on the spouse visa (5 year route). We are coming up to its expiry and will need to apply for an extension. Before we do, we are likely to have a baby that will be born in the UK.

If a parent is British when the child is born the child will be British automatically.
Your wife’s visa application is separate.
Child doesn’t need a visa! Apply for BP straight away.

Sorry for the follow up - would i need to add the baby to the spouse visa extension application as a dependent?

No, the child does not need a visa if the child will be British.

Hi everyone,

Hope you are well!

I am struggling a little with a spouse visa extension application. i am a British citizen.

23 March 2024, we received a letter from HO that our first application for entrance clearance was successful.

In the letter, it mentioned that my Mrs, from Pakistan, could travel to the UK to collect her BRP from 30 March 2024.

"This notice explains that, when you arrive in the UK, you will have permission to be in the
UK (known as permission to enter) as PARTNER (Standard) from 30 Mar 2024 until 30
Dec 2026."

My Mrs entered the UK on 26 April 2024 (stamp on passport) and collected her BRP card. She left the UK on 2 May to return to Pakistan to complete her degree, help brother with his marriage arrangements, help take care of her mum during this time and complete the rest of our cultural marriage ceremonies.

She came to the UK (with me, and my family) on 4 October 2024.

My question is:

1. Do we need to apply for the visa extension on or after 2 December 2026 and before 30 December 2026; and

2. When did she move to the UK? If its 26 April 2024, we would put down this date throughout our application for the following types of questions:

*What is the start date of your current visa or leave to remain? is this 30 March 2024??

*What is the end date of your current visa or leave to remain? 30 Dec 2026?

*Time lived in uk? --- if we count from April 2024 (when she arrived first) to 30 Dec 2026, it would be 2 years and 9 months. But if we count from Oct 2024 to Dec 2026, it would be 2 years and 3 months (and if the visa is extended it would be a total of 4 years and 8 months - shy of 5 years). But i know that for spouse visa you are allwoed to be out of UK for more than 180 days as this rule applies only to other types of visas...

*Date you left UK - 2 May 2024

*Date you returned to UK - 4 Oct 2024

*When did you start living at this address? 26 April 2024???

Please can you advise? Apologies for any confusion. Its just that i am not sure.

Spouse Visa Extension - Degree taught in English

Hi everyone,

There is a question in the spouse visa extension application:

Do you have a degree taught in English - the degree must be equivalent to a UK Bachelor's degree or above. (Yes/No).

Country the degree was taught in: Pakistan

Does your degree meet the English language requirement for the visa (Yes/No) - unsure.

My Mrs has done the A2 exam and passed. She also has a degree from Pakistan which was taught in English. We have a certificate from Ecctis to state that this the comparable UK qualification is a bachelors degree. It mentions that we do not have a certificate - but we do now.

How should we proceed??

Hi all,

I have watched a number of helpful videos on Youtube by those completing the Spouse Visa extension application. However, there is a new (if i can say this?) question that has not been covered. It is making me think i have the wrong form at times - or maybe i have answered earlier questions differently - any guidance would be so helpful:

Question: How you entered the UK?

Options:

1. I was granted temporary admission or bail at the UK boarder.
2. i entered illegally
3. Other - i selected this and entered 'Spouse visa - entrance clearance'.

My Mrs BRP card just states 'Leave to Enter' It does not mention spouse visa (maybe an update) or its different on the evisa? How should this be filled in?

- is it right to say she moved in on 26 April and started living at this address (same date) and we started living together (same date)? Great if this could be confirmed just for peace of mind.

Lawyer wanted to charge me £250 for these 3/4 questions. I was surprised as a few law firms give one free consultation.

Would it be ok if i followed by asking the below:

Question: How you entered the UK?

Options:

2. i entered illegally
3. Other - i selected this and entered 'Spouse visa - entrance clearance'.
