ICT to Skilled Worker Visa

Hi Team,

I travelled to UK in first week of July-2016 on a ICT visa and did few extensions inside uk and the expiry date for ICT visa was June-2021. Before the expiry of ICT visa, inside UK i did applied for Skilled worker visa in May-2021 and visa start date is from June-2021, did few extensions inside UK and its valid until Nov-2026.

Considering the current immigration rules (white paper),

1. Believe I will be eligible for ILR on a 10 year route and just wondering what would be the earliest date I can submit my application ?. Is that the (ICT Application date or Visa Vignette start date or arrival date in the UK) ?

2. My family (Wife and Kid) came to UK in April-2018 as a ICT Dependents and part of my ICT visa extenstion as a dependants and later they were part of Skilled Worker Dependants, as of today they have completed 7 years of continuous residence in the UK .
a. The question I have is do they need to complete 5 Years in UK or 10 Years continuous residence to be eligible for ILR ?.
b. Also is there any impact on the tenure (5 yrs or 10 yrs) due to recent white papers to be eligble for ILR ?.
c. If 5 year of continuous residence make my dependants eligible for ILR, can they apply along with my application around (May/June-2026) ?

1. Visa vignette issue date.

2. They can apply for ilr on form SET O once you have ilr. This is based on 5 years residence.

There are no new rules yet. It is a white paper and proposal at this stage.

1. Just on this - On the recent white paper , though its a proposal at this stage

Are there any changes expected/proposed for the dependants continuous residency to be eligible for ILR (will it be still retained as 5 years or will be changed to 10 years) ?

2. Do my dependants need to wait till the primary applicant gets the ILR decision/visa ? OR can they apply along with the primary applicant ?

1. We dont know anymore than anyone else on aht possible changes.

2. If they apply when you do, their applications will be held and only processed after your ILR is approved.
