Silled Worker dependent VISA Plus ILR dependent visa - Time spent in UK for ILR eligibility

Post by Saurav999 » Fri May 30, 2025 12:06 pm

Hi All,
Please help with my query. I received my Skilled Worker VISA of period Mar 21 – May 26 and I will apply for my ILR at some point in Feb 26. I got married in 2022 and my wife came to UK in April 2022 on dependent skilled worked VISA valid until May 26 (4 yrs 2 months). In my understanding she must apply for ILR dependent VISA before May 26 to continue her stay in UK.

Once she moves onto ILR Dependent VISA,
Ques:
1. When can she apply for her ILR?
2. Will this VISA transition reset her time spend in UK clock for ILR eligibility?
3. Will the time spent on both VISA’s be considered together for her application in 2027 or does she needs to wait till 2031?

1. When she meets the 5 year requirment jn 2027.

2. She does NOT have to switch visa category. She extends her current visa for a further 3 years.

3. She stays on the same visa route.

U sure why you think she has to change visas???

Thanks for the reply.

1. U sure why you think she has to change visas??? "The reason I think she needs to change her visa is as I am the primary VISA holder, on the basis of which she received her dependent Skilled Worker VISA to last until May 26. Now in case the primary visa type changes - I think she has to change her visa."

2. She does NOT have to switch visa category. She extends her current visa for a further 3 years. - "What will be her new VISA type as I only has validity of Skilled Worker VISA until May 26?"

3. She stays on the same visa route. - "Wont the changes in the primary visa type, have any impact in this case?"

I may be totally wrong with my understandings but please guide as What type of VISA will she get post May 26 to be dependent on as my primary visa has validity until then only and I do not have any provisions to get mine skilled worker visa extended.

Your wife does not need to change her visa!

She extends her visa as a Skilled worker dependent for three more years as advised above, the fact that you have ILR is irrelevant. Dependents keep the same visa route once the lead applicant is granted ILR. ILR dependent visa does not exist.
