Submitting UC application while a child is on NRPF

Hi all,

My wife and myself have ILR (based on 5-year skilled worker visa). However, my daughter is still a dependent on my SWV.

We’re submitting a joint UC application, and our daughter is in the application. Would this adversely affect her later ILR application? She has a brother who is already a British citizen.

Why did you not add your daughter to your wife's ilr application as you were advised to last year?

If a the child is subject to immigration control (ie - no recourse to public funds restriction) you claiming benefits due to their presence may breach their immigration restrictions. However, I’ve never seen a case in practice where this has been an issue for a child. It’s a choice you have to make as to whether you want to take a potential albeit unlikely risk.
