Hey all, I wanted some advice. I am about to apply on behalf of my uncle for British Citizenship under Section 4L of the British nationality act 1981 using form ARD,
He was born in 1953 in Pakistan. His mother was a CUKC by descent (her father was UK born and in the crown service at the time of her birth in 1917) she was formerly registered as a CUKC in 1956 unfortunately a few years after the birth of my uncle who was then included on her British passport till he was a teen. She reached out to the UK government for advice on how to send her son (the applicant) to UK / register him as a CUKC/British subject but was not given very helpful information and was told that since his father is a Pakistani citizen so would he be. Her status wasn’t passed to her husband neither her sons.
On the contrary her brother registered much the same way as a CUKC and his wife also became a CUKC by virtue of their marriage. Not only that but the uk home office advised him the following:
“This decision does not confer citizenship of the United Kingdom and colonies on your children… they are Pakistani citizens under Section 3 of the Pakistan Citizenship Act 1951… if confirmed, they will be British subjects under UK Law per section 1 of the British nationality act 1948, free to enter and reside in the uk permanently..”
Their entire family managed to move abroad and were naturalised whilst my grandmother was never advised the same way even though their circumstances were similar.
I have all these letters as proof and evidence of the correspondence.
Not only this but the applicants paternal grandmother was also a CUKC by descent (unfortunately it was not passed down to the applicants father because it happened when he was an adult) she even later naturalised in the uk after having moved there later in life.
Please let me know what are his chances of obtaining citizenship through this route. Basically we will show how his mother was treated unfairly in comparison to her brother a male. And how the applicant was barred from Obtaining British status due to this unfairness and discrimination.
Also, the applicant currently resides in Pakistan. Would I need to courier his original passport to the Liverpool address.
Please any kind of guidance and assurance would be greatly appreciated. Our family obtained ancestry visa n citizenship through his mother, and it’s a shame that he wasn’t able to obtain the same. The ancestry visa is an option but a very expensive option and my uncle is now over 70 making it much more difficult,
