Route to ILR for dependent

Hi All, I'm on a 5-year skilled worker visa and I'm completing 5 years next year October. And my son, is with me on a 5-year visa. And my wife was my dependent until 2022, but later she moved on to skilled worker. Because of that she will be eligible in 2027. So I want to know when I get ILR in October next year, can I apply ILR for my son, because he also completes 5 years as my dependent or need to wait for my wife’s ILR then apply.

No, your son cannot apply for ILR with you if your spouse is not qualifying for ILR at the same time. The rules dont allow this.

Your son will qualify for ILR when your spouse does.

Children born abroad to non-British parents follow the same pathway as the second/less-privileged parent, qualify for ILR with the second parent and can register as British citizens when both the child and one parent have ILR AND the other parent has become a British citizen or is applying for British citizenship.
