Hi there,

Hope you are doing well!

Sorry for writing big post, this I am posting behalf of my partner (wife).

We are 9 months away to fill our ILR application……
We moved to UK in Aug 2021 from India on Trier 2 Skilled Worker Visa. My Spouse(wife) is main applicant and I am dependant to her.
visa valid from date: 17/Aug/2021 (on a passport entry clearance visa sticker)
date of entry to UK is: 21/Aug/2021

1st Employer Tier 2 Skilled Work Visa Oct 2021 to Feb 2022 (applied from out of Uk and got visa and then moved)
2nd Employer Tier 2 Skilled Worker Visa Dec 2022 to Jan 2024 (switched to another employer with in the UK)
currently on a 3rd Employer sponsorship Trier 2 Skilled Worker Visa since Jan 2024 to present continue visa valid until 28 Jan 2027 (switched to another employer with in the UK)

so you if look at our journey we had 9 months gap between second employer to third employer (approximately 270 days) hence I have below questions, please any one can help me to clear my doubts??

apart from this 9 months employer gap, no more than 28 days absence / holidays we have stayed continuously in UK only.

1. She had a gap of nine months in her payroll (Feb 2022 to Nov 2022) during a switch between 1st employer sponsorship to 2nd employer is this impacts to our ILR application?

2. We are on 3rd Employer sponsorship with in this 5 years period, is this impacts to our ILR application?

3. Wife and husband both can submit ILR application at a same time? or main applicant only first?

4. Is the £26,200 yearly salary threshold is sufficient for ILR application? according to 2023 December ongoing wage rate this is the salary offered by the current employer.

5. Do we have to pay a council tax (if we are renting the house) mandatory for ILR application? does this have any impact? (sorry, if this is irrelavant question)

6. What additional Engligh language proficiency documents are required for spouse / dependants applying for ILR apart from Life in UK test?

1. No. ILR has nothing to do with employment gaps. It is all about continuous lawful residence

2. No

3. Yes, a single SET(O) application can be used

4. She should meet both the general threshold and the min going rate for her job.
For most people, the general threshold is set at min of £29,000. For some, exceptions do apply so it could be as low as £23,800

5. This has nothing to do with ILR. Council tax is a civil issue. Legally, it is the matter of whether you are liable for it or not. However, there is no requirement that you must be paying it to become eligible for ILR

6. SELT exam also mandatory? for ILR for dependants? Life in the UK test is not sufficient?

6. B1 English test AND the LIUK test are mandatory. LIUK alone is NOT sufficient.

3. Yes, one form, add dependents.
