ILR eligibility for skilled worker dependant children

Hello everyone,

I would like some guidance regarding my children’s ILR eligibility.

I received my Skilled Worker visa in April 2021. My children joined me later in June 2021 as my dependants. My husband subsequently obtained his own Skilled Worker visa from his employer in December 2021.

Based on my visa dates, I will complete 5 years in April 2026 and will be able to apply for ILR around March 2026 (within the 28-day rule).

My questions are:
  • Can I include my children in my ILR application even though their dependant status started in June 2021?

    If they cannot apply with me, when will they are eligible for ILR?

    Do both parents need to have ILR before children become eligible, or is one parent’s ILR sufficient?
Any clarification would be greatly appreciated.

No you cannot.
If they cannot apply with me, when will they are eligible for ILR?
When your spouse qualifies.
Do both parents need to have ILR before children become eligible, or is one parent’s ILR sufficient?
Your children qualify when your spouse does. Tney cannot apply with you, it will be refused for them.
