ILR Eligibility date Query

I am planning to apply ILR for myself through 10 year route . Please experts can you help with few clarifications .

My stay at UK : entered UK on Jan 26 2016 through ICT which was approved on Dec 30 2015 and switched through to skilled worker by Dec 2020.

Question: What would be the date where I would be eligible to apply ILR considering 28 days rule.

My wife and my son entered UK by 2nd June 2016. My son is my dependent till now. But my wife switched to student visa from 7 Jan 2021 till 30 Jan 2023 and back as my dependent from 1st Feb 2023.

Question: Please can you advice on date which I can apply ILR for my wife and son considering 28 days rule.

Note : none of us has stayed more than 180 days away from UK.

You can apply now based on long residence.

Ypur spouse and son will have to wait till 2028, when your spouse has 5 years as a dependent OR June 2026 if they each individually meet the 10 years long residence requirment.

I understood that my wife and son can only apply for ILR by June 2026. To fill the between gap I believe I can only apply for 3 years skilled worker dependant visa extension for them

Hope my understanding is correct.

Hi Lolo2 , their visa expires by 4th Jan 2026.

Then yes, they need to apply for a three-year visa extension as you rightly pointed out.

Apologies, have a follow up query , kindly help.

1) Whilst filling for skilled worker dependent visa extension , it’s asking whether main applicant already have their skilled worker visa , believe I need to choose “No” for this as technically main applicant would have got ILR by that time - is it correct understanding? Kindly confirm

2) if I choose “Yes” for above it’s also asking end date for skilled worker visa of main applicant . Please advise what date I need to give ? Is it the actual date which is 4th Jan 2026, after that main applicant will apply for ILR

3) it’s as well asking for CoS number . I believe I need to give old CoS number but do we need to give as well start and end date mentioned in the CoS- please advise

Thanks Zimba for the quick response . I used Jan 2026 as start date of CoS and end date as Jan 2029 . It’s asking me to pay £517.50 . Am I missing something ? I thought the IHS charge amount would be close to £3000. My wife as a dependent is here at UK for 9 years and six month.

IHS is calculated based on your own visa expiry that you entered. CoS date is irrelevant

Thanks for the input again Zimba. Understood that the CoS expiry date needs to reflect the future date which is roughly 3 years from now.
