I hope you are well. I would be grateful for your advice regarding our family’s visa situation and the most appropriate next steps.
My husband was first granted Skilled Worker leave on 28 April 2021 and, as I understand it, he may be eligible to apply for Indefinite Leave to Remain (ILR) from around 30 March 2026. Our son and I were granted Dependant visas valid from 1 August 2021, and we both entered the UK on 14 August 2021. Based on this, we believe we will complete five years’ continuous residence on or around 13 August 2026.
All of our current visas (my husband’s Skilled Worker visa and our Dependant visas) are due to expire on 31 May 2026. My husband is planning to submit his ILR application in April 2026.
We would be grateful for clarification on the following points:
After my husband is granted ILR, should our son and I switch to the Family route (as dependants of a settled person), or would it be preferable for us to extend our current Dependant visas linked to his Skilled Worker route until we become eligible to apply for ILR ourselves?
We are unsure whether it is possible for us to continue extending our visas under the Skilled Worker dependant route until we reach ILR eligibility.
If we apply to extend our Dependant visas (for example, for one additional year), would this be permitted, and would we be required to pay the Immigration Health Surcharge again as part of that extension?
We would appreciate your guidance on the most appropriate and cost-effective approach, as well as any risks or considerations we should be aware of.
